OK looked Nankins up on line, but if they go broody all the time you won't get many eggs

I have an OP that loves to go broody, she also mothers her chicks till they are almost as big as she is, this I think tells the rooster "I am to busy for you"
 
I am in Eastpointe, just north of Detroit. I got 12 chicks this past spring and my lot is 85'x281', more than enough room for chicks. We have a field behind our house and our property is kept up very well. No odors or mess. I have a copy of the animal codes that just says, "no commercial farming" and "no roosters". It shows the code was printed in 2007, though I am certain I picked up the copy from city hall in 2009 or 2010, that is when we started thinking about getting chickens. The violation states the same code number but reads differently, "no live poultry". I plan on going to get another copy of the codes and to find out when it changed. Has anyone here fought to get the codes changed in their city? How difficult do you think it might be? My thought is the code was changed because of the city may have just wanted to update all the codes. In recent years there have been pitbull issues and I know our city was looking at the dog ownership codes. In the copy I have, there are many old codes such as no tigers, elephants, jaguars, hippos and so forth. There used to be an old time amusement park in the city way back in the early 1900's. So my guess is the city was just trying to modernize the codes. Thank you for any advice you all can give me.
 
It is so nice out this morning. 73 today....It's going to get cooler though the rest of the week. I am really looking forward to Saturday though! I hope the weather stays nice, we have an outside function to go too and really don't want to be walking in the rain all day.
 
Freedom, have you mentioned the MRTFA to your township? Sometimes that's enough and it's worth a try. From the research I've done, I cannot find any instance in which the RTFA has protected anyone against zoning laws. That doesn't mean it can't/won't ever happen but you'd need to be prepared for a legal battle. I contacted my State Rep and he was absolutely no help. Of course he didn't actually contact me himself. He completely disregarded my question asking if zoning isn't just a local ordinance. I don't think he wanted to go there. Your state rep might be of more help to you. Good luck.

Chapter 610.06 (Passed in October, 2009)

(a) No person shall raise or keep game cocks within the City.

(b) Live poultry and game birds shall not be owned within the City limits.

(c) No person, firm, or corporation shall sell or offer for sale any baby chicks, ducklings, or other fowl or game as pets or novelties.

(d) Exceptions. This section does not apply to:

(1) Any person who is transporting such animal through the City provided that such animal is adequately restrained to avoid injury to persons or damage to property;

(2) The keeping of such animals in a bona fide licensed veterinary hospital for treatment; or

(3) The keeping of such animals in a bona fide educational or medical institution or other place where they are kept as live specimens for public view or for the purpose of instruction or study.

(1973 Code Sec. 9.66) (Ord. 1015. Passed 10-6-09.)

Shucks...it is pretty specific. HOWEVER....you are allowed to keep up to two ducks??? Both of these ordinances were passed on the same day.

Chapter 610.04 FARM ANIMALS.
(a) No person shall keep or maintain in the City sheep, goats, pigs, cows, horses, or llamas.

(b) A person shall be permitted to keep or maintain a maximum of two rabbits per household.

(c) A person shall be permitted to keep or maintain a maximum of two ducks per household.(1973 Code Sec. 9.64) (Ord. 1015. Passed 10-6-09.)


Seems a bit bizzare don't you think?

Thanks for finding the codes for me. I was at my city's website and couldn't find anything. It looks like these ordinances took effect just after I picked up the copy I have now. There is a light...I homeschool my children. That may qualify as the educational institution.

Hard to get rid of them boys isn't it?? Im thinking I'm going to end up having to send some to freezer camp, but hate to do it right before deer season, I need the freezer space.

Freedom, I'd see if you couldn't get grandfathered in. Use your copy of code that you got, and say you had your chickens while THAT code was still in effect. If you only have girls, I don't see where neighbors would complain... And use the MRTFA too. You're self sustaining... Worth a try.

I just double check on my township website to make sure I was still zoned ag here. Especially after the kid/chicken/police/ incedent. And yup, still Ag zone here.
