Migratory Birds and the Law

FEDERAL LAW TAKES PRECEDENT

I agree but show me where Migratory Bird are protected when killing Livestock. It's simple they ARE NOT, they may be protected at the State level, BUT NOT at the Federal Level.

Show me a clause in the federal statute that makes that exception...

The federal governement specifically provides “Unless and except as permitted by regulations made as hereinafter provided" exceptions for certain birds such as dove and geese. This particular law does not provide exceptions for birds predating livestock or poultry. Other laws protecting other animals may make that exception.

The feds do not require a state to repeal a law that is inconsistent with federal law; however, they can forbid its enforcement. If you read the US constitution you will discover that federal law preempts state laws. Federal courts rule all the time on laws that are considered to contradict federal law. Depending on the specific provisions of the law, it may be ruled that it is a constitutionally protected state statute, or that it contradicts enforceable federal law. The constitution grants the federal government the sole right to negotiate and sign international treaties, and the power to enact statutes to enforce them.

It you wish to taunt the law, expect and be willing to pay the consequences.

This is about as lame a statement as I have seen today. Oklahoma currently has at least 2 laws in court at this time. Arizona currently has a Law in court also. California has had numerous Laws repealed. If this Law is unenforceable it would have been repealed.

If this Law is unenforceable it would have been repealed.

Not unless someone took it to court. Otherwise it's just one more meaningless law on the books

No matter what OK says, and no matter how you keep trying to reword it, it's STILL against Federal law to kill any raptor UNLESS you have a depredation permit

To get the permit, you have to prove you've tried all other means to deter the predator.

Oklahoma just recently passed a Law allowing the hunting of Black Bears. Black Bears are also a protected animal.

Black bears aren't under FEDERAL control
The state can do whatever they like with them

They have nothing to do with migratory birds

Ask your local ranger/warden about depredation tags/permits first. The chances of be fined for killing a hawk or an owl if they are attacking livestock in Oklahoma is slim and none. 1st, we have a TON of hawks because they have no natural predator. They are adversely impacting quail and rabbit populations. They are attacking pets in urban areas, and we have the double whammy as the coyotes do the same. The problem is we are loosing landowners at an alarming rate, combined with the numbers of active hunters dropping every year. Shoot the darn hawk if its attacking your chickens....shoot coyotes on site year round. There is nothing to keep the balance in check other than a ticked off landowner and a loaded gun.

Kill 'em all! Zero predators is a nice balance. Then the rabbits can over-run the country--like in Australia

Not to mention the mice and rats and snakes. Hawks do so much more good than harm. They've gotten a few chicks of mine, but when Ive caught them in the act, I just marvel how beautiful they are. I dont begrudge them that. If I loose a few to hawks, so be it. Ive never lost a full grown bird to a hawk, so I try and keep the youngsters close by, so its my fault if I lose one.

They are so gorgeous.
