Migratory Birds and the Law

Rabbits are not native to Australia, they were introduced and are feral...nice fallacy. Here we are talking about managing an entire ecosystem. We have taken the habitat for development and farming out of necessity, we have introduced a buffet of penned chickens into a system that normally would have these predators in check to to limited food supply. Now that we have altered the balance, they don't have to work so hard for food, they multiply at accelerated rates, and so it comes full circle and we have the responsibility now and we must kill them to keep them in check.

Its not pretty, but its the right thing to do. If you are one of those folks that would fight development to save a fly, then we all know that all you want to do is fight for the sake of fighting. This isn't college and we aren't impressionable youths bent on saving the planet from the peril d'jour. You cull your stock, you deal with the nasty business of keeping that balance, same goes for the system you are in...geographically. Different issues regarding predation and over populated predator species are different by geographic location. Some predator issues are similar, like the coyote. We have more coyotes now than we have ever had on record not just in Oklahoma, but nationally.

This is something the hippies that want to go "off the grid" are learning the hard way. Buy your land, build your cabin by hand, have your solar array and battery banks, your windmill wells and cisterns. Compost Everything and start your flock, maybe add a cow or some goats, Go to sleep and dream happy hippie thoughts...wake up and your cow has run off and your chickens are dead. You go to town for coffee, complaining to the old codgers who gather at the co-op every day and they look at you like you are from Mars because you left out the most important tool for sustaining a small farm...a gun. Get one and control the predators or they will kill your livestock...its so simple its stupid.

There aren't natural predators--same here before the coyote came back--we'd see 50 rabbits on a one mile drive. Nobody was able to have flower beds and veg gardens had to be fenced.
I'd trap several mice EVERY day. Woodchucks and geese were everywhere. The deer went nuts--one could legally bag 7 of them for a while. I have NO problem with securing my birds.

According to the OK law, if a Hawk is sitting on a fence post he is protected, If a Hawk is chasing down a mouse or a rabbit he is protected, if a Hawk is ripping the guts out of the Cat he is protected. BUT if he attacks your Chickens he is fair game. This law does not mean open season on Hawk and Owls, but it offer some protection against needless killings.

I caught this Hawk in the act of eating my Chicken, I didn't hunt him down I didn't set a trap for him, and I didn't leave bait out hoping to catch him. I gave him 2 choices, he chose option B.

And if you were arrested and fined $10,000 it wouldn't be under OK law.

It would be a violation of the FEDERAL Migratory Bird Act

Just like "medical" marijuana" is "legal" in Cali, but the Feds will still arrest you for it.

I caught this Hawk in the act of eating my Chicken, I didn't hunt him down I didn't set a trap for him, and I didn't leave bait out hoping to catch him.

If the chickens were out, they were the "bait", whether it was intended as such or not.

OK law may let you "protect" your animals, but Federal law says you must CONTAIN them FIRST, before resorting to killing raptors

YES!! It is really simple to understand. NO hawks or owls may be killed or trapped under Fed laws except by a federally licensed trapper.
 
Ok...ok...you federalists win...you are right and we are wrong. Meanwhile, in the Great State of Oklahoma we have yet to see any feds in rural areas handing out fines for killing predators. When we see one we will let you know so you can say you told us so.

That has no bearing on whether or not it's legal.

Game wardens have the power to enforce Federal laws too.​
