my own personal hell- any help welcome

I am pretty sure they are wrong about me not being able to have my domestic game birds (ducks and quail) since there is NOTHING in their laws about it, only laws making livestock and avian livestock illegal but quail and ducks are NOT considered livestock. I think they are just making stuff up. The farm stand is bull too since there are no laws not allowing it, but they are trying to say I am not in a retail zone, well what home stead farm stands are?????

I will have to fight for my ducks and quail but it will be hard cause if I dont pay off the right people (this town is very crooked) But I have read all the laws and there is NOTHING about it anywhere.

I know many people raise rabbits the same way I raise my quail and I know that is allowed in my town.

can you sue him for discrimation(sp) why should he be allowed a garden and your not. can you call a local tv station and complain, usually they like to get all the publiciy they can, and really play up this is your way of life and what you are trying to teach your children, how you are helping to keep our planet green, Didn't our first lady plant a garden, is he saying he is better than her? marrie
Just noticed, he called you dirty and low class, sue him for slander.No person has a right to judge how another person lives.

You are not going to like this answer. Chickens, ducks and quail are often listed and included as livestock, and unless the town ordinances or state law specifically defines livestock without including them, then it is correct. Also, that is the manner in which you are raising them--as a small scale farmer. And I do not believe that having a gamebird license from the state will override or negate city ordinances.

The idea that you need a license to farm is ridiculous, however! You may need a license to sell your produce, eggs and meat; however that type of law is more likely at the state level.

You need to first find the actual ordinances and statutes and thoroughly read them to see what they actually allow/disallow. Then you need to find out the process for filing for a variance or use permit for the farm stand. In both of these options support from your neighbors is vital; support from the community is very helpful.

Try to keep your battle efforts focused on your goals, and not about the official. Make yourself look to be the more adult and reasonable one.

That's what we all want but some jerks make that almost impossible. If you don't fight, he will just keep doing it to other people and you will have to give up something you love.

Really, don't they have something better to do?! This is how the cities act about things like this. They do the same here. For crying out loud, what were you hurting? Not a thing. How sad is this. Look into the ordinances like you are going to, and see just where you come out at. One very good thing is, you've got your neighbors on your side. I've heard that that is half the battle. I wish you the very best. Please keep us posted.

Uneducated people bother me to no end. Don't they know how healthy and organic all of your stuff is and better on the enviroment because there isn't big trucks hauling it around? I think they wacked their head on something abit too hard. And for the man who reported you, no wonder he didn't get voted for mayor. He just wants to get some attention.
 
So sorry to see this. I say it's a political battle... and looking at the comments on the article you definitely have the communities vote so that may quiet the politician as he won't look good.

I think fighting it to the extent you can keep your ducks and quail is appropriate. You looked into the laws and got your license.. you definitely went through the legal process to have them.... I think if you hadnt .. that it would be different. Fight for your birds at least. Maybe taking your stuff to the local farmer's market would be a better alternative than the stand. I bet you sell out every week too as this publicity is going to help you on that front....

You know that if you decide to stand and fight, we'll all be here supporting you. That goes for if you decide not to-I hope you do. Your way of life is definitely worth fighting for-don't give in to jacked up, crooked politicians! Keep us posted!
