Need Some Legal Advice

In the state of Ohio, the law states the vehicle title has to be transferred withing 30 days of the sale. Since your brother has been driving it unregistered, he was driving on the previous owner's tags.

YOU need to get the title transferred and have the vehicle registration & tags in YOUR name. Then get liability insurance EVEN if you are selling it in a few days. I would much rather pay one month insurance and not be liable in the event of an accident (those can be very pricey). Also, if someone gets pulled over while the vehicle is in it's current title/registration situation, there can be penalties & fines imposed.

So whos name is on the title..your first post said , the previous owers name, my guess he would have to go get the truck.

Laws different from state to state.

Here the title must go thru every buyer name...they have to get their sale tax on each sale too.

Yep only have 30 days here to get it put in your name.


BIG THING HERE IF SOMEONE DRIVING YOUR CAR it better be insured. I know a couple lost their farm ,because of what you are doing,. so i would never leave a car in my name after selling it. This couple was trying to help her brother out, car was still in husband name , her brother got it a major wreak........they lost the lawsuit 250.000....because the title had not been tranfer to him yet.

I would get the truck,then do the title and insurance all in one day.Never do these types of things for family.To often it bites you in the butt.There will be hard feelings,boo-hooing,and then anger. Ignore it all and do what is legally required to get rid of the truck. Do not argue or explain.Things were made clear when he got it,and unless there was hospitalization involved there is no excuse for him not holding up his end.
 
I don't know what your title laws are, but here you would get a whopper of a fine for it being in limbo regarding title versus driver owner issue.

But, once before when I had to repo a car a hired an off duty officer to do the job for me. Kept me out of the drama. Went nice and smooth he parked the car in my driveway. I went to DOT and made dead certain all of the paperwork was clear and in my name. I was advised to wait to sell it to make certain in case the other person did try to file a claim for it. There should not have been any case of me losing the case, but it was a precaution. I sat on it for 30 days then sold it again. I learned how to put a lean on a vehicle and never sell with a debt unless I hold the title and lien until the debt is cleared.
