Lets hope your local EPA office enforces the law as they should and doesn't shrug it off like local law enforcement did...

FYI an individual that violates the EPA FIFRA (as this neighbor has) is subject to a fine up to $1000 and/or up to 30 days in jail... Of course it likely will never get that far (at least we can hope) but it's not some $10 ordinance violation that many would shrug off...

The label of any pesticide, including mothballs, states exactly where and how you can legally use the product. In general, mothballs are pesticides intended only for closed, airtight containers to kill clothes moths and other fabric pests. The fumes they produce should remain trapped inside the container to kill the clothes moths. If mothballs are used in a way that allows the vapors to escape into occupied air, they can be harmful to people or pets that may breathe in the vapors. Good news, I'm guessing a certain neighbor really isn't going to enjoy the EPA showing up and knocking on their door for violating Federal Law...

Make sure to print all this out and even take notes of your phone calls to build your paper trail of harassment and illegal activities by the neighbor...
 
I honestly can't believe they are trying to sell their home now. Hopefully, the property will be red flagged to alert potential buyers that the wells and soil could be contaminated.

I spoke with another officer today to document the dog barking recording again and shared the mothball information with him. He was more of a narcotics specialist, but he was very interested in keeping the information on mothballs and wanted to do everything he could to abide by the EPA. He did not ridicule me like the officer did yesterday. In my opinion, this has gone way beyond a "tit for tat" mentality. This is being personally directed toward me to create harm to me, my family and my chickens. I am going to put an end to it soon. They evidently are seeking trouble. I'm working on harassment charges now and I am going to do everything I can to enforce this Federal unlawful pesticide use. In the meantime, the mothballs are dissolving into the air and soil with all the heavy rain and heat and no one will remove them.

Good luck, the EPA can be a real hassle when trying to sell when get a thorn in their butt... Had a friend that was a home mechanic, the village told him to stop but he kept pushing the issue the village eventually called the EPA on him for soil contamination (fluid leaked from vehicles) coincidentally they called right when he put the for sale sign up... He had to spend several $1000s digging up his gravel driveway and having it removed as toxic waste, as well as putting down a new driveway and having multiple soil test prior to selling his house it was a nightmare but he brought it upon himself...

And those moth balls are obvious and plentiful, they are going to have a hard time trying to make excuses when the EPA shows up, time for you to sit back and enjoy the show that is about to start...

Are the mothballs in there yard or yours? If its in theres i would make a barrier of dirt so that you can reduce the chemical exposure going into your yard. Its goingto be a pain to decontaminate all that soil it is ruining not to mention all the animals it is going to harm. Ya i think i would go over there and force them to clean up the mothballs but thats just me.

I just bumped into this thread today, looked through it, and shook my head. Stick by your guns lady, don't move nor budge an inch. They have no right to do what they have been doing. They are harassing you, plain and simple. Let the leverage of law force them to yield. Rich folks seem to think they are entitled to… It don't necessarily work out that way.

The mothballs are on their side up against the privacy fence which has hardware cloth installed to close any gaps. So far, I think the chickens are just curious of the smell and the white looking things. Hopefully, she has not dropped any into their run....haven't seen any yet. I have about 4-8" of sand on my side that I keep cleaned daily. Gets pretty hot now and I have pools, etc. to cool them off and they can go under the 10 x 16 shed as well. I am working on a barrier made from very large old signs that I have on hand. EPA should be out soon and I'll see how they handle things. The dog barking recording is really getting annoying...Who let the dogs out" I want to sing every time I go out. The officer out yesterday stated that chickens can get used to any sound around them. Why should they? What about me? Maybe I should call animal control and report a dog closed up in their detached garage or something. As far as forcing them to clean up the mothballs, I will leave it to EPA or someone else. Thanks for the suggestion, though.

Really any chemical not used as directed is a violation of federal law, its states this on all chemical packaging, even bleach I think.
