Neighbor threatening court over our roo

Uhg! I don't envy you, neighbors is exactly why we got out of town! Our house in town is for sale and them damn neighbors still aren't happy...to all the nosey people in this world...thanks for making life harder then it already is oh and tell me is it hard being so perfect?! ...rant over :oops:

Haha! That's what my husband said! Maybe a 12 foot privacy fence? We made sure to check and there is nothing about fences in the covenants :D
I think a 12 foot privacy fence is overkill, an 8 foot fence would work out just fine. Maybe plant some fragrant roses or some lilac near the coop so that the problem neighbor can’t claim that your chickens smell.
 
I spoke to a lawyer this morning and he thinks we would win if it got to that point.
He said since there is a long history of not enforcing any covenants and that the HOA was administratively dissolved by the state, a judge would throw it out. He said if a client came to him that was in our neighbors position, he would tell him he would probably lose.
In the meantime, we have a meeting with the president of the HOA (when there was one) this week, to see about getting some covenants removed and/or amended.
That’s a lawyer for you. He’ll say that of course he would. You’d be better served if you consolidate the other children owners and go after approval for your chickens. This is a sage old battle lost by many a dog and their owners. Pick your battles keep your eye on the prize not revenge.

Yes, we spoke to our 2 chicken neighbors. We are hoping to change some of the outdated covenants.
I wish I could have your attitude about it! It's so tempting to do things that would drive him crazy....
 
I had a neighbor who complained to the town about our rooster which we were giving away anyway (supposed to be a hen), he didnt even tell us and complained about the coop aswell. We had to go to the town board and have them give us a permit for the coop and the one complaint caused a lot of trouble, i would be careful about what you do.


I tried a no crow collar, and it only annoyed my roo, if it comes down to that i would bring the rooster somewhere where he could crow like he was meant to

How long did you try it for? Mine don't even realize they have it on. It took about a month of adjusting, but everyone is happy.
 
we have a neighbor who is building his retirement home next to ours (he doesn't live here yet, he's here for a couple days maybe every 3-6 months.)
He called this morning and wanted to speak to us.
He told us our rooster is a problem and he needs to go. Threatened us with court and asked if we had a lawyer.
Here's the thing - there are covenants where we live and they do say no poultry (the covenants were in effect in 1979.) There is no HOA, it has been inactive for several months. We have 2 other neighbors who have chickens - one of them has a rooster. There are also several other rules in the covenants that are broken by multiple people.
I got defensive because I think it's ridiculous. I understand not everyone is chicken people, but there are dogs barking all hours of the night and he wants to complain about our rooster?! UGH.
We plan to speak to a lawyer to get some advice, but has anyone else been in this situation?
