Now what... UPDATE: How many of you rent?

Well, it seems that the bank may win out on this one after all. We were served with court papers today and are to appear in court on July 6, 2009 for "Unlawful Detainer." In other words, to be formally kicked out of our house...

We know - and the Dept of HUD knows - that what the bank did was illegal. They sent us a loan modification contract on May 12 and asked that it be notarized and received back by them, along with $1215.00, on May 14th. We did as they asked, and they still "sold" our house (the bank bought it "back") on May 18th! Supposedly there's a HUD investigator working on the case, but we still received our notice to appear in court...so now what?

I have 6 dogs, 9 cats, 6 birds, fish and chickens. How on earth will we ever find a place to rent that will allow us to keep our fur and feather kids? We've lived in this house for going on 13 years (rented it for 9) and have put SO much time, $$ and WORK into this place. I'm just heartbroken over this, because we have tried every way we know to get the bank to work with us (for the past 15 months!), and they just ignore us and ask the govt for another $34.5 BILLION! There's no way we could have foreseen the economy taking a nose dive and DH's hours being cut, but they don't seem to care. They want us out, so the house can sit here like a zillion others in our neighborhood.

Sorry, just needed to vent...if nothing else, we'll pitch a tent at the farm where my daughter boards her horses I guess...

I am so tired of hearing stories like this.

My electrician was here at the house this morning and his mortgage company was sold to another company and they weren't informed.... the bank continued to make auto deposits to the old NOW defunct company and then they were served with foreclosure notice!

Who knows where the auto deposits ended up for 6 months. They had to come up with some BIG money to save their home.
 
Keep working with the investigator.

Make sure you have all the loan modification paperwork and the receipt for your payment when you go to court. I don't think a judge will side against you on something like that -- it's a broken contract on their part.

You should call your local Legal Aid too. They can help you find a lawyer you can afford.
 
We have all our paperwork, and our HUD rep (who's been our intermediary for the past 15 months) helping us as well. However, I'm tired of fighting and of being stressed out and crying all the time. I just want to move somewhere and get set up and be happy again.

I hate the idea of renting, but we'll do what we have to do. I refuse to move anywhere without my fur and feather babies, though, so I'm keeping my fingers crossed we can find what we need.

We're going to rent a storage unit this weekend and start moving stuff out. There's no way I'm going to let the bank have any of it (other than the appliances, etc. that were already here), including all the flowers I've planted. If I have to, I'll host a "digging party" and take donations for any flowers dug, but I refuse to leave them here for the bank to ruin, after all the landscaping work we've done to this place over the years.
 
If you have the loan modification paperwork that shows that you did pay...and maybe..try..try..to save a bit of money for the july court date....they may have to work with you....maybe...

Sorry to hear, we just moved and got set back up here. We bought my mom's historic house, it was my dream to have an old home. We landscaped, built a very nice chicken yard and coop. Redid the basement, I can't even name what all we did for nothing. Made all the payments straight to the mortgage company in her name, I thought hey she's my mom, if she say's pay it in her name because the mortgage company won't deal with switching it over to me it'll be fine. Well..... she didn't tell me after a years worth a payments paying extra every month and paying insurance on it she would file bankruptsy and I have to move because she maxed her credit cards out. I lost. What's more heartbreaking my mom did it to me. My mom. Ok I have to quit because I am making myself cry thinking about her.
 
I've always had the belief that everything happens for a reason and that when one door closes, another opens; it's just so frustrating and the "not knowing" is killing me! I've been saying for years that I want a place with land, so maybe that's where this is all headed...

Your right something much more greater than where you are now will come along, maybe moving will give you and your family some unexpected favorite memories to share. I'll put you in my prayers tonight. It was harder for me to move than anything I'd had to do.
But, we're both glad we're back to our little house we started in.
It just took awhile for me to figure it out.
