It's not a venomous snake for sure I'd need to see the underside to be certain but looks like a Ring-neck snake the tail is a bit long kinda like a Coach-whip but 5 inches seems too small to me to be a hatchling, A Ring-neck would have an orange'ish to yellow belly with black dots on each of the scales esp. near the vent. A lot of snakes take the same defensive posture and doing so makes the head appear to take on the triangular shape some more than others like the Hog nosed snake is really good at that and as a defensive illusion works to fool would be attackers, Unless the attacker has a giant shovel but it still can't hurt to try even if you're only 5 inches long LOL
We have ringnecks on the farm that get to be about 8 inches. This hatchiling isn't a ring neck...no orangey coral color about the neck or underside. It was the same color underneath as on the back...muddy brown. There was no visible stripe or pattern on the body...that's what made us think it was a baby.
