Thanks Lisa " The Chicken Lady"!

To not be misunderstood, DD KEPT hitting dog on top of head and elsewhere! It never let up! Husband shoved DD out of the way and shot the dog half in and half out of the back run. I wish the dog would have stopped at only one chicken and DD would not have SEEN it happening! She has since brought up the fact of being leery of going outside by herself. How dare the neighbors make her feel that way!!! Sorry rant there, trying to keep heated emotions out of the post lol. If anything happens today, I'll post it. We are leaving soon to look at motion lights at the hardware store. To the op who asked about fencing our land we live on almost 3 acres, if we could afford it, we would right now! Believe me! Thanks everyone!

Citation: KY ST § 258.005 -991

Citation: KRS § 258.005 - 991

Summary: These Kentucky statutes comprise the state's Dog Laws, which were amended significantly in 2005. Included are all vaccination, licensing, animal control provisions, and the relevant dog bite statutes. Under Section 258.235, any person may kill or seize any dog which he sees in the act of pursuing or wounding any livestock, or wounding or killing poultry, or attacking human beings, whether or not such dog bears the license tag required by the provisions of this chapter. There shall be no liability on such person in damages or otherwise for killing, injuring from an attempt to kill, or for seizing the dog. That same section also comprises the state's new strict liability law for dog bites. Under Sec. 235(4), any owner whose dog is found to have caused damage to a person, livestock, or other property shall be responsible for that damage.

I'm sure local attorneys have this, but I'm printing it out and holding on to it. Just in case....

What gets me is the neighbor seemed to imply that as the dog was killing the chickens we SHOULD have taken it by the scruff of the neck instead and held it till they could come get it! It had NO collar on! AND this was a BIG dog!!

Well, there you go. No collar, which means not tags/rabies tag, etc. They could get in big trouble for not having their dog licensed. could have been a stray dog for all you knew. You were totally in your right to do what you did.

I just found this thread and I am absolutely horrified for you. I am both a dog and chicken owner and you did what you had to do. I would have done the same thing. I just hate that it had to be a neighbors dog, not a coon. At least a wild animal wouldn't have awful neighbors to harass you afterwards.

OMG-

YES you should ask for compensation, but through a small claims court. I'm sure they will turn a cold shoulder if you just ask your neighbor.

YOu did the right thing, how scary for you (esp your daughter!) I know it was a hard decision, but you had to protect your family!

About a year and a half ago I had 15 chicks that were about 10 weeks old. I was having so much fun watching them grow, seeing them change. That was until a pitbull wandered up because the female dog I had at the time had gone into heat. The pitbull attacked my niece's dog. Gizmo later died from the injuries he sustained from the attack. Later the pitbull got into my coop and killed every one of my chicks before we could stop him. Needless to say that was the final straw. The dog had to be put down. No question. We are dog lovers and we hated having to do that. But we had alot invested in those chickens. Not just monetarily either. I truly loved them. I do feel your DD's pain. I hope she feels better soon.
