Opened a Can of Worms I didn't want to!!! I need some horse advice.

So I bought my horse almost a year and a half ago. The story is, she is an Irish sport horse, has papers but still owned by the original owners. Okay, That's fine, I didn't think I wanted them any ways untill my new trainer asked me if i have her papers because she wants us to qualify for year end awards with dressage when we start showing.

so I contacted two owners back, to make a long story short, the owner with the papers wants her back. EEEK, even though she sold her, she still wants her back

. She is legally mine, we paid for her. But what's to stop the other owner to try and get her back *if* she finds out we have her? Is there any kind of documentation I can get, its kind of a sticky situation.
 
Do you have receipt or cancelled check to show that you bought her?

I think previous owners would have a hard time proving she was theirs since YOU have possession and they don't!
 
Yep contact the breed registry and get their advice. They may help you get the papers. They may also blacklist the breeder. My horse that was stolen has a flag on his pedigree till the owner (they didn't know. I just want contact. If he is in good condition they can keep him) contacts me. Until then none of his foals can be registered.
 
if she was sold legally there isn't anything they can do, papers or not. at least in the us I think they can choose to sell without papers and I don't know the legality of getting those, but at the very least they should not be able to just take the horse back.
 
If the person you baught your mare from didn't complete the sale terms and conditions on their purchase contract, like didn't complete paying for this horse, the original owner has legal rights to this horse. The fact that you paid for this horse to your seller may not hold up in court since your seller didn't legaly "own" this horse. In that case your seller can't legaly sell this horse , so you legaly don't own her. A consult to an Attorney that is knowledgable in animal law would be very prudent on your part. Good luck !!!
 
A couple other thoughts should the breeder decide to give you a hard time.....
You have probably had a vet out to see her since she's been in your possession who would write a sworn statement that you have been solely providing and paying for the care of the horse.
Also, is she chipped and if so if the chip registered in your name?
If their is no bill of sale and the breeder tries some funny business, write up a nice big bill for the 18 months you've had her: Feed, boarding, vet services, farrier, training....you would legally be entitled to recover all those costs. In the end, those fees may add up to whatever the horse is worth or more. The other "owner" would have a hard time convincing a court otherwise and may just decide it isn't worth trying to steal the horse back....just a thought.

Let's just hope it doesn't come to all that and that you have at least a canceled check or something that proves you paid for the horse though: It would be SO much easier.
