They both look like cockerels. The drooping saddle feathers are a distinctively male trait, and it looks like they both have them.

Here are a couple pics from when they were younger. The same bird is always on the left and the other bird is always on the right.














 
The one on the left is definitely a boy. Can you get better pics of the crest of the questionable one? Is it bearded? It's hard to tell in those pics. If not, check for wattles. How old are they? (sorry if you already said)
I have pullets that have "droopy" saddle feathers.
 
Better pics of the crest? Like how do you mean? I posted quite a few from 2, 3, 4 mos old so the variances are shown and I also have close ups, front view, side view, and view from the top. Not really sure how else to take better pics?

I think that by droopy they actually mean that they are hanging down.

Here is a good example of the "droopy" feathers. No, this guy isn't mine, but I wish he was! From the newest pics you posted, I would lean toward pullet as well. See if you can get some pictures of the saddle feathers that are coming in. Look for iridescent, pointed feathers. If you find those, it's probably a cockerel.

 
Sorry I should've clarified. Closer pics of the crest of just the bird on the right. And most recent. Better lighting would help too. It looks like the feathers are really pointy and spiky in some pics and in other's it doesn't.
 
are polish good layers? I really really want polish! I am in love with the buff laced frizzle polish and also the slate colored ones. I'd love to start up a project pen and raise them for locals, but I don't have room to build another coop area, so I'd have to essentially replace my existing LF flock. which I don't know if I want to do that or not yet. I dont' have a rooster, so I guess I 'could" just put them all together and just hatch out the polish eggs.

do polish do well with other breeds? or do they get picked on because of the large crest?
 
My polish hens lay between 2 and 5 eggs per week, they are not very reliable. They are also in a separate coop than my other girls, as their crests are a target for the bigger gals. We keep Polish not for the eggs, but for their fantastic personalities. They are positively delightful birds in my experience, they absolutely love to be with their people. Ours will follow hubby and I around, but we have to be careful walking as they dash under your feet while you are walking.
