Question , kind of legal regarding check payment

You paid them, and the moment they took the check from you hand, they accepted it. If they didn't like the method of payment, it should have been said before the payment was accepted. You are not obligated to pay them again. If the check bounces, then they can come after you for payment. I would suggest you stop doing business with these folks.

My guess is that they lost the check, and want the cash or that they will run the check the same day you pay them cash.

Exactly. This is their problem, not yours and I would not tolerate any attitude from them about it! I really, really hate people that like who try to bully and throw around threats of legal action for any little thing that doesn't suit them just so. I would not be doing business with them again in the future just for that reason alone.

what are you trying to write a check for?...

at any point and time a business can change its policy and start refusing personal or business checks... there is no law saying a business HAS to take a check...

I suggest if you dont like the business practices of that company move on there are many more that will take your money.

My first question would be why are they holding a check for eight weeks?

I deposit checks on a regular basis, weekly. No eight week old stuff laying
around.

Was it ever presented to your bank and refused? Is so, maybe then I might
consider handing them cash.

But for no reason? Nope.
