Question , kind of legal regarding check payment

I have a feeling there is an issue with THEIR bank account and if they deposit your check they are going to lose the money.
Say they have overdrawn their account and now have a few hundred dollars worth of fees to pay. Anything that is deposited into that account will be put toward the fees. There is nothing legally they can do to you unless your check bounced which as you stated hasn't even been presented to your bank. Next time they call let them know that you will be pressing charges for harassment.
 
Simply put, its their problem, not yours! You wrote the check in good faith, providing you do have funds to cover it. They accepted your check so they could have said CASH preferred but didn't.

Tell them to cash that check to your bank and let them deal with it. I don't believe banks don't accept checks, they do but sometimes they will "hold" on to that check making sure it is cleared before they release the funds to you that was owed.

Businesses, that is another matter, and they DO let you know ahead of time checks are not accepted if you ask (same for accepting credit cards). Common sense.
 
I have written them a letter, will go to town and send it certified. I printed a listing of calls they have made to my phone in the last week, almost 100 calls (thinking this is a clear case of harrassment) , I have asked that they stop calling me, as they accepted the check for payment and also stating I offered cash, but they stated a check was fine. I have a prepaid cell, everytime I get a call it cost me, unless it is from a phone from the same carrier. So, I have not answered several of those calls.

Oh and I have several calls from other local numbers, I googled those and they are in the same area, so most likely they are trying to trick me into answering the phone. I have nothing to hide from, but why would I spend my hard earned money on phone minutes for someone harrassing me constantly.
 
I wonder if they lost the check and now the bank doesn't want to take it because it is kind of stale, or still lost. They might have been screwing over their bank which now doesn't want to fool with them. Or they could just be tools.

Another possibility is that they are trying to convert to cash for tax reporting reasons.

At any rate, if I had a good reason to want to keep doing business with them I might give them cash if they gave my check back.

No reason for a legitimate business not to take a check if you haven't stiffed them in the past.

I did read your post.... and I will state again... at ANY TIME a business or person for that matter can change or revise their payment policy....

if the original check that bounced was returned to them for NON payment.. your error or the banks... if the funds were refused then you are on the hook for the money... check your bank statement.. if the returned check was not honored then they are still out $X.XX + whatever bank service charges THEIR bank charged them... its between YOU and YOUR bank to decide who or IF you will be reimbursed by your bank

how can they still have the check if they tried to put it though and it bounced?... do you mean they have the cancelled check? if thats the case pay them the cash UPON receipt of your cancelled check...

If you re-read, the check that bounced due to bank error was an entirely different payment than this one and it WAS honored by the bank. The check they have now, they have never even TRIED to cash.
 
So...fun question...why not pay with a Money Order from Wal-Mart? Costs all of $0.60 and they can cash it at ANY Wal-Mart.

Just sayin....is this for services rendered? Goods purchased (as in all of it is in your hands as of right now) or is it a boarding/ongoing payment thing?
