~ Retired and Starting My Future In The Foothills ~

I would definately get a lawyer. might not win against the township. But they can get you a stay of execution, while everything is getting figured out. File suit against the realitor. Hopefully in the end, she will keep her fowl, the realitor will cover all legal fees and a nice dinner.

In the meantime, is there a possibility of "purchasing" some extra land from a neighbor so that you will be in code? How much land are you needing to gain in order to be in code? I would be SO ticked off. Well...I say that...birds aren't allowed here either...but I'll be darned if not every house here has some birds!

That option has already occurred to me; there are two properties "behind" mine, and I can't see the houses on 'em, so they're good sized bits of property. I would dearly love to purchase half an acre from either on of those folks, and I'm gonna see how reasonable it might be to do that.

I suspect the real estate gals (who are now aware of the situation!) probably only checked for HOAs and CC&Rs (Community Covenants & Restrictions) NOT zoning restrictions.... But they're 'on the case' now. That's my first step.

This is what I was thinking also. I believe that the current property has around 2/3 acre so another 1/3 acre needed. Have the realtor purchase the additional ground to make you within code since she is the one who dropped the ball.

I have loved watching this thread and hope everything works out.

I am so sorry that this happened! I hope that it all works out. The real estate market is full of sharks..well, always has been, I guess. People out to make money off you without providing you proper services. FWIW if I lived next to you with lots of land I would definitely sell 1/3 acre to a fellow chicken-keeper. If it was in your contract that the sale was contingent upon NO restrictions on fowl on the property I would bring that up to the proper authorities. Best wishes.

I'm hoping this is resolved quickly for you. I can't imagine the stress of the move and now this. Keeping you and your feathered friends in my thoughts.

It was up to them to check for ordinances, especially since you had it written into your contract that your offer and purchase were contingent upon there being no restrictions to fowl. They did not perform their due diligence on your behalf which they were contractually obligated to perform.

Let us hope their Errors and Omissions Insurance premiums are paid up.
