X2Double check your livestock protection laws. Dog is at least harassing livestock which in my situation is gray area that law enforcement will side with livestock owner. Also have a camera ready for photographing dog trying to get in. Last dog I dispatched was photographed multiple times before I did deed. This provided pictoral evidence needed to tangle with neighbor concerning property damage.
I'd call the police/sheriff. If only to find out your rights in your area. The first time on of our neighbor's dogs came and killed a few birds they were talked to. We also spoke to a deputy, off the record, he informed us that while our county doesn't have a leash law, AL does and that supersedes the local law. Two days later was the second time the dogs came, 4 months later, I weighed my options.
1: Shoot them. Fine by me but they run as soon as they see/hear me coming. They need to be on our property for me to shoot them legally, regardless of what they are doing.
2: Talk to neighbor again. And bid my time waiting for them to come back.
3: Report it to the sheriff's office.
I chose option 3. Option 1 is still a possibility if I can manage it legally. 2 days ago a deputy came out and took a report. He informed me that I can have a warrant sworn on the owner for having dogs at large and he'll be arrested. I did not do that, yet. I have 1 year to change my mind on the warrant and if the dogs come back, and don't wind up dead, that is what I'll do.
If I hadn't been home the other day I would have probably lost all of my birds instead of only 2. It is unfair that we should have to worry about others continuously roaming dogs. I wouldn't just shoot a dog because it was on our property, even though it is legal here, but if its killed or is in the process, I'll do what I can.
