Gravity is still theoretical. Newtons Theory of Gravitation, which he himself wisely called a 'Law', was a theory.
Newtons 'Law' was found to be flawed in certain cases when compared to Einsteins General Theory of Relativity.
I'm only pointing out that Gravity has still only been explained theoretically, not empirically. Theories are as near to fact as we'll ever get in some cases because the empirical is physically impossible.
This applies to both sides of the argument/discussion though. Not being able to disprove something does not automatically make it fact.
