Seller on e bay plaguarized listing with my photo - even watermarked!

I think she has not heard ebay or even having to refund at least one buyer....I have a phone call in for e bay and one for my attorney....I hate to waste time and money on this but maybe the Good Lord in his infinite wisdom wants me to explain to her that stealing is a crime in three ways, morally and legally and spiritually.

When you all have time, you may want to scan e bay and look at photos in the egg types you have I have found my egg on 2 buyers so far!!! Soon I'm going to put name tags on my birds before my reshoots. I've just so had it with this mess. But I shall not let our farm be taken advantage of....Our birds need to be fed and so I will keep after this and anyother person or entity using our photos without permission!

Just thought I'd post this (taken from Ebay's policy page regarding images and text at http://pages.ebay.com/help/policies/image-text.html under 'Other reports'):

"If you’re not the original creator of the picture or text or if you don’t own the rights to the material, you shouldn’t send a member report or report the listing through the VeRO program. However, you may consider contacting the rights owner directly with your report."

Nancy, I was wondering how you found these photos if you don't sell on Ebay? I don't think I've had any photos stolen but I also doubt I'd be able to find them if I did.

ETA: Also, this is right below the 'Other reports' section of that same page, you might want to send it to her next time you message her:

"Copyright law protects original works of authorship—which may include certain pictures or text—from being used or copied without authorization from the person or company that owns the copyright, its agent, or the law. You can find helpful information about copyright law at www.copyright.gov."

shellyd2008, a BYC member who was looking at my listings saw my ee listing and reported it to me.. The BYC member had already complained that the eggs she received looked nothing like the photo and we all know why. ..I'm pleased that she did as I would have known nothing about it. I don't buy ebay eggs. I buy eggs only from those BYC members who I know or have sold to my friends where I can see the results or directly from those who are working with a particular breed I'm working with.

I was glad she told me because I wouldn't have thought to look there, as that's not my source of eggs. I went back to check and see if the eggs in the hay were gone, Yes, they were but now replaced by my eggs in a carton...I have high speed internet and I will continue to look for my pics as often as I can! Now, I must go back to the business of farming and build a coop!

Bargain, I sent a message too. I have been oggling at your listings here on BYC, and it infuriates me that anyone would steal other people's hard work. I sent a message as well, and will post if there are any replys.

That photograph is property of Garry Farms. Not only did you steal the picture, you cropped the picture of other details. However, it is still clearly identified. Pictures, the instant the are taken, are property of the photographer, and are protected by copyright laws.

I suggest you start taking pictures of your own eggs from now on. You spent all this time and energy stealing and editing other people's photos when it would have been much easier to take your own.

I hope Garry Farms pursues this matter in court, seeing as you have made a significant profit from the use of their photos to falsely advertise your own eggs.
 
If you noticed she is trying to cover her butt with people who buy her eggs by saying all of the sudden they have started laying green and pink eggs. It is just wrong to steal someone elses image. I used a pic once of a Delaware roo to show everyone what my roo looked like as I couldnt find a pic of him but let everyone on here know that that wasnt him or my pic. If she i going to use another persons pic she needs to check first with that person and ask permission and then let her buyers know that the pic isnt hers and that that is what her eggs look like. I am glad you are going after her. I would be very upset if I ordered eggs from her thinking I was getting blue and green or pink eggs came. That is one of the reasons I have never bought eggs from ebay.

Nancy, if I may make a suggestion? The type size on your watermark really needs to be way bigger, at least 36 point type. In the case of your image, when the size is reduced, you can barely see the line of type. Just a great big ol' "ⓒ The Garry Farm 2011" would be more effective and would not be easy to ignore.
