We have the same law here too, we are a right to work State but unemployment requires history before you can really fire anyone. No history then the State gives them unemployment. Also, HR is not allowed to tell you anything about health issues. They can only take the paperwork and dr.'s notes and that's all, they are not allowed to say anything else regarding medical conditions. FMLA is in effect here and it's Federal Law that this company must follow, Federal Law precedes all State Laws period. You do have a case here if they do terminate your husband that's for sure. I would seek out a Lawyer and get advice on what your rights are and what you should do if they should term your DH.

The only thing that may hurt him and is partially my fought to keep him from having double the dr bills.. He's had something like broncitis with fever off and on since oct along with all the other problems.. so he missed a day in Oct and was sick also this passed fri when he went to the dr.. He went for 3 things on fri.. to try and get his blood drawn for testostorone test (which may be another thing goin on, alot of other issues that are symptoms of that) which they couldn't do where he was sick.. to find out whats goin on with the passing out, and while he was there to get some anitbodics for whatever type cold thing he has goin on. FMLA will not cover anything acute. It has to be more major, so their wanting to buck on it because he also had "acute Broncitis problems" also.. He has went and had his monitor put on and if allowed should go back to work tomorrow. He still has to call the HR guy before 5 today to see if he recieved the fax of his leave forms from the DR and what he decides. He goes back tomorrow to get the monitor taken off but not sure how long it'll take for the results for it to come back...

He's never passed out without coughing first and he only does it when he has a flare up with the broncitis type stuff, so I'm not sure everything else thats been tested he's passed with flying colors. The only thing left that hasn't been tested blood work wise is the testostorne which i dont think has anything to do with this but may be the reason he having other problems.

He does have a lil anxiety problem and his worst fear is not being able to breathe. His doctor also thinks the passing out might have something to do with that, kinda like he's getting chocked from coughing so much then when he looses his breath he's panicing on top of that, and hyper ventalating and causing him to not get enough oxygen..

Thanks everyone for keeping us in your thoughts, I'm sure this is all part of a bigger plan, and whats goin to happen will happen as far as job wise. I need to try and quit stressing but at least we should know for sure on the job today and it'll be done and over with, and start trying to figure out what steps to take next..

Gosh I am so sorry for what you are going through. No suggestions just hugs and prayers from this corner.

Thanks guys, its about 15 til 5 here and 5 is when the HR guy leaves.. he's tried calling him all day with no luck last time he called the lady in the office went over to see if he was in his office and told him he was in a meeting and would call him back, that was about 45 mins ago. Think the waiting is stressing me out more than anything.

I say not to worry for now. You should make sure you have all the dr.'s notes though. It's up to your DH to show work if it's FMLA related or not but your work is not allowed to ask him questions regarding his medical issues other than if it's FMLA related or not. I know you heard of HIPPA, he signed it when he went to the dr.'s the first time, it protects him from his employment finding out about his medical issues too.

DH did turn in all his paper work from the begining and they told him when he was out and left for appointments to let them know if it was under his FMLA and he did.. The HR guy said that the weak spells and passing out was not covered under his first medical leave so we had to go through it all over again, even tho its all probably tied in together.. IDK its all crazy..

Did get some good news!!!! he finally got ahold of the HR guy and he can go back to work tomorrow, told him he'd see what he could do with the new leave forms and the passed points.. I took this as meaning he's not fired at this point but not out of the water?? I hope it all works out, He hasn't worked any this week so if he works tomorrow he gets his holiday pay for fri and mon since they are off those two days for christmas.. we might be tight this year and not being able to buy gifts for anyone, but this is the best gift I could have gotten!!

Now to wait on the results from the heart monitor, but i feel like the spells have to do with his aniexty not to mention this probably hasn't helped it AT ALL
But thanks for keeping us in ya'lls thoughts and prayers!!
