Let me just say this.... I have NEVER written a letter that poorly ...not even in Law School much less after.

Do check this out...it is possible a secretary wrote it for a lawyer but it is just a poorly written professional letter.

Also, DEMAND not ask but DEMAND to see these written village rules/ordinances etc.

It must be in writing that you can have no live chicken and it also must be in writing what the recourse of the village is...ie, 10 day notice and so forth.

As to your neighbors getting mad Who gives a crap? You have a RIGHT to see what they are using to make this demand and your have a RIGHT to stand up for your chickens and see if you are indeed in the wrong.

That is a generic letter designed to scare you into submission. You need more details. The chance of them actually filing a lawsuit in ten days is unlikely.

I agree with all of you. It is WAY too easy in this day and age to make up a legal letter using microsoft software, and then using some law office out of the phone book to make it look legit.

Hold your ground and find the ordinance. Attend the next council meeting and so on.

Good luck!

Don't give up! And find out who the nasty neighbor is!!!

Update: I went up to the Village Clerk's office and asked for a list of the city ordinances. She pulled out a loose leaf folder that was about 3" thick! It took her a while to find the ordinance about chickens, but she printed out the page that she thought was relevant. This is how it's worded, exactly.

3-1-8 ANIMALS IN VILLAGE

(A) Certain Prohibitions. Except as otherwise provided in this Chapter, no person shall keep within the village any cattle, cows, horses, sheep, swine, goats, chickens, ducks, turkeys, geese or other livestock.

(B) Exceptions. This Section shall not apply to areas of the Village that are zoned agricultural, nor shall this Section apply to livestock brought into the Billage for the purpose of being shipped out the Village, nor shall this Section apply in those instances in which written permission has been granted by the Village Board of Trustees.

(C) Health Hazard. The Mayor shall have the power to issue an order prohibiting the keeping of any animal, fowl or bird which is deemed to pose a health hazard to the general public.

Apparently someone complained about the chickens. I do have five young roosters who are just beginning to crow with that scratchy more like a meow type of crow, and I've had them listed on Craigslist for a couple of weeks with no takers. Maybe they complained because of them?

Anyway, the clerk told me that I can call the Mayor, and see if he'll let me keep them until the next board meeting where I can present my case. I'm not good at speaking in public and I'm a nervous wreck! My husband called the mayor, but was only able to leave a message.
