Someone Please Explain This To Me

Technically, If you give him eggs, and he gives you ANYTHING in return, you are selling the eggs. That includes goods and services.

If he turns around and sells the eggs in any way, you and He need a handlers cert.
If he takes them home and eats them for breakfast, no cert needed.

If you trade him the eggs and he sells them directly to customers (as eggs) , they have to be graded( A, AA, E etc...) AND they have to be labled.

Again, if he just takes them home, no lable needed.
 
See? I told you the language was difficult! :mad: Everyone has a different take on this.

Here is the plan: I will tade him the eggs, just a couple dozen a week, in exchange for whole bean coffee. If he decides to use them in the coffeeshop, what can I do? In my opinion, he could use them there or not, and I really don't know. I will be upfront with him and tell him, "These eggs are from me to you." It is his business, so I will let him make the final decision.

He was going to use the eggs from his home flock, but they were killed by wild dogs. I think I mentioned that before. I was trading eggs with him as one chicken friend to another, as I really felt for his loss.

And I wanted free coffee!

Wow Dangerouschicken, my eyes hurt just from reading it all. I want to sell my eggs at our famers market next year. The city gave me a 4-page must do list....I just about cried.

You are not grading them ..period.

And if you were selling at the farmer's market or a "pop stand" on the side of the road, you have no way of knowing what the consumer will use the eggs for ..so again, you are exempt.

As for coffee ...do you prefer a light roast or a dark? Have you tried Goat Rock by Taylor Maid ? It's a dark roast and very, very yummy! Organic and Fair Trade, too

Well, I went and saw him today. I said, "I am giving you these eggs. [I handed him the eggs] What you do with them is up to you. It is a gift from me. If you want to gift me coffee in return, that would be okay." He totally got me. He said, "I prefer to do most of my business in trade if I can, and gifts are even better."

BTW, he said the first one he cracked open was a "beautiful orange-colored double yolk egg." He added, "That is a very good omen."

Edited to add: I gave them to him at the coffeeshop. Will he sell them in food? I don't know.

is the guy gonna sell them??? If not, then you won't need a license. A license applies to people selling to other people....EG: I sell to Ed who sells to Jeff who sells to Mike who sells to Janet who eats the eggs, gets sick, and wants to know where they came from. Hence the license.
