If you could sue (I have no idea), but if you could.. one would think you'd make up the difference and then some in damages.

How unoriginal was she?? What ended up happening in your case?

i didn't pursue it. it wasn't necessary. people figured it out REALLY quick.

when you face paint like the pics below, and someone shows up to do junk, the impersonators die out! (yep, that is my work, they are both my daughter, Hannah)

Awesome work!

Unfortntaely just licensing your business here in washington is no prevention of identically named business in the other States. If one of them were to begin selling their products in WA, though, then you have a point. I believe, though, that internet/E-Bay copyright ownership is based upon the state the sale is originating in, so you're probably boned on this one.... unless you federally trademarked yourself.

That happend to us and we had to "buy" back the domain name. As far as the Secretary of State / Corporation commission goes, we had established that long before the the internet was active and had bank accounts to prove it so they had to switch their buisness name. But here is another loop hole for the game. A buisness can be registered as "Mary's Little Lamb, Inc." and function as DBA "Lil Lammy". If your registered name is "Lil Lammy" you still can't do anything because they are technically registered as "Mary's Little Lamb"
