Someone turned me in to Animal Control

Hello there! You have heard about my little foundling chicken, Pepper, who showed up at my house on July 5 as a baby. You've also heard about me stressing tough about his crowing and my 3 backyard neighbors. Well, yesterday Animal Control came because someone reported me because there seems to be a NO ROOSTER law in Fontana , Ca where I live. Now I have 30 days to rehome him.
I cried most of the day.
Someone suggested registering him as an ESA. Will that allow him to stay with us even if he still crows? ?
My granddaughter has handraised him. For almost a year before she was going thru a horrible depression and the 2 chicks, Pepper and Rosie, brought her so much joy and actually got her back on track.

There's no such thing as registering an ESA. You may find sites online that will send you a certificate or something if you pay them, but that's a scam. There's no registry for ESAs. For an animal to be an ESA, you need to get a note from a doctor or psychiatrist saying that animal helps you in some way, usually for things like anxiety or depression.

As far as if you could keep him if he was an ESA, they are protected by the FHA:

"Although emotional support animals do not have the same access rights as service dogs under ADA, they are protected under the Fair Housing Act (FHA). If you meet the criteria for ESA qualification under the FHA, you are entitled to live with your emotional support animal free of charge and deposits, even if your building doesn’t allow pets. The FHA also prevents housing providers from imposing breed and weight restrictions on your ESA. Many state laws mostly mirror the FHA, which provides additional protection against discrimination for ESA owners. Housing providers are required to provide reasonable accommodations for ESA owners so they can have equal opportunity to use and enjoy their residence."

I don't, however, know if that would help in your situation. This seems more geared toward a renting situation. I don't know if this would circumvent town laws.

What about a crow collar? It really cuts down on the sound.

I am so sorry. Same thing happened to me. I ended up making my little guy a house rooster until we moved to a rooster-friendly area. That appeased the laws where I lived at the time (Sacramento County). As long as he was inside, he was allowed to remain. To get him exercise, I would take him to a nearby park. We took him on a leash, but I had considered one of those pop up play pen things.

I'm so sorry your going through this. Its so hard to be forced to get rid of a pet.
I'm not sure about ESA's, but maybe you could talk to you neighbor and offer a different solution? It might be to difficult at this point, but maybe bring a carton of eggs, and be as understanding as possible. Like mentioned above, maybe talk to your neighbor about having him inside your garage from evening until late morning. That is when they crow the most. Maybe letting him out after 10 ish and see if that helps keep the noise down. Of course it depends on the rooster. My roosters tend to stop crowing for the most part after breakfast, but if your rooster crows more often you might have to have him inside full time.
Maybe see if a carton of eggs every now and then will make up for minimal crowing during the day? I think the time that most people care about crowing is early morning and the evening. Maybe your neighbor wont mind the crowing periodically throughout the day after a talk over a carton of eggs.
I highly recommend not using No-crow collars. They can be dangerous. There was a thread a while back about one killing/strangling a rooster. Plus it works by making it uncomfortable for them to crow, thats not something you want for your sweet boy.

Roosters are not allowed anywhere where I live. I placed him in a rooster sanctuary.

I’ve had a few sensitive ones do the same thing. It’s scary and sad when they do that.

I was fortunate to have found this place...its called the Island of Misfit Boys. I love that. The director is amazing. Im hoping Pepper and Rosie are happy.
