If possession is nine tenths of the law I would go get him. Then I would have possession and tell the uncle to prove he owns the horse legally.

Basically he can't because you have all the paperwork.

the horse market is so down...wen't to a auction in dodge city a couple of months ago and saw a good (papperd) ranch horse go for $125.00....pretty sad. i haven seen a horse go for over $1000. in about a year or so....better watch out the beaver horse sale is comming up in sept (major one in north west okla)
 
Personally if you know where they horse is I would go get it! I would not bother w/ the police, I'd wait til he was not at home and I would go get my horse!
 
Alright, so after filing the report, I called the investigator. He wasn't at his desk.

He called me back and told me this:

"The state investigator and I have decided that this is a civil lawsuit. We cannot get involved."


I am SO peeved I could just...GRRRRR!!!!!!

So, if they will not get involved, wait until the losers who stole your horse leave their property and take your horse back. You'll need to get someone to be a lookout for you so you know when they leave.

Maybe do a night time recovery.

ETA: Find somewhere to stash him for the first month where they won't think to look.

I guess I've missed this...The guy whom you leased the horse to...When you confront him does he tell you that the horse belongs to him now? What does he tell you? i personally would go to his barn and wait until I got an answer...If he chose to call the police...all the better...I went through a similar situation some years ago...When the leasee didn't return the horse as set forth in the lease; I issued him a bill, for 5X the value I thought the horse was worth. It was sent certified mail. It stated that this was the amount due to complete the sale of the horse and the bill would be reissued for 3 months then sent to collection...I also placed a lien on his property for 5x the value of the horse....He called me 2 days after he was served with the lien and said that it was all a big mistake....i collected what he owed me times 3...then I removed the lien....
 
Oh, I like the idea of billing the guy 5x the value of the horse and putting a lien on his property ... if the guy has any, that is.
 
If you cant get any law to help you out and get your horse back. And they say it is a civil matter that you have to take to court. I would just go get my horse back. Since they are theives, I doubt they would have the money to file..

I would stake out the place. Figure out where the barn is. Where all the gates are.. If they have locks.. And last but not least, I would make sure where they keep your horse at night..

Then I would park my truck and trailer in a location not well seen. Wait for them to all leave. And I would walk through the property in dark clothes at night. And walk the horse out to the trailer. Load him up and go on my way..

I would just hide him out for a while at a friend/relatives house. A few months down the road bring him home. My it is awful when a thief gets some thing stole from them, which they stole in the first place.. And you know nothing about it right..
