Stolen Horse--Man is BACK in jail!

"The state investigator and I have decided that this is a civil lawsuit. We cannot get involved."

So get yourself to the clerk of courts and file one. And while you are at it, ask for an injunction requesting that the judge order him not to move the horse or use it (as in rodeoing where it might get hurt) or lend it or sell it to anyone until after the court hearing. PLUS send him a registered, return-receipt-requested invoice/letter stating that since the lease has expired and he did not fulfill its terms, he has the choice of returning the animal OR paying you cash of $xx,xxx.00 immediately. Do this so you have something formally written that shows you have not abandoned your rights to your property. Phone calls do not count in a court of law. Judges want to see a paper trail of what you did to recover your horse. Oh, and keep your copy of whatever you filed with the sheriff. It lends credence to your claim that you did not abandon the animal, which is what the lessee is going to try to claim.

And if you win, be prepared for a counter-suit by him for care and boarding for however long the animal has been out of your hands.

I guess I've missed this...The guy whom you leased the horse to...When you confront him does he tell you that the horse belongs to him now? What does he tell you? .

I called the guy and he said he doesn't have the horse anymore and that his uncle now owns it. I called the uncle and he said "No, it's MY horse now."​

The uncle is haboring a stolen horse. Just as the same for a stolen car.

Go and get your horse back but do it legally. If you must pick up the horse at the uncle's property, be sure to get the sheriff at his town to assist you in getting the horse back.
 
Rusty Hills Farm and EweSheep both have good ideas. Billing and a lien is a great idea. Going and getting him is a better idea. What about calling a repo guy?
