Stolen Horse--Man is BACK in jail!

If I knew where to find it,I'd get your horse for you. Send me a plane ticket & a map to this guys house. I don't believe in today's court system. If the horse is yours just go get it!. Then drag that guy by his boots to Oklahoma.

As long as the party who has the property is willing to let it go without a fight it would not be a criminal matter. While you are allowed to use force to protect yourself from violence at this time in our country you are not allowed to use force to retrieve personal property, you have limited rights to use of force while you are in possession of the property. An example of this would be conviction of OJ for using force to retrieve property he claimed was his.

Armed with a court or repossession papers from a magistrate or a judge is a different matter. It makes a lawful demand of the recipient of those papers to turn over property to the owner. Use of force is still limited unless it is by a officer of the court who may need to effect a arrest to serve the papers and allow the retrieval of the property. Repo papers also allow what would normally be criminal trespass to the holding party's property to retrieve it, without fear of arrest.

My neighbor's a laywer. A pretty darn good one in fact and were pretty good friends with the guy. I wonder what he would say about this. I'll have to ask him.

The OP does own the horse. She was leasing it TO the person who stole it, not FROM him. He defaulted on the lease, removed the horse from the barn where it was to be kept and then sold it.

As a horse lover and owner for many years this is shocking! I had this happen to me when I loaned a pony to a man my family knew well for his grand daughter and they up and left never to be seen again. I kept looking for 5 years, finally found someone who had purcahased the horse at a sale yard and got a new trail, 2 more years and found my pony at ridding for the disabled. When I produced the paperwork and police reports they offered to return him but I opted to leave him there as he was to small for me to ride anymore and the kids loved him.

Never give up hope and keep going, try everything and when it does not work try again. I really so hope that you get your horse back
