The lawyer wanted to know if I had tried to go to the place myself with someone to help me and I said that the sheriff's office would not back me up and I didn't want to get injured or anyone else for that matter in the process of taking him back. The uncle had an awful temper when I talked to him on the phone much less taking a horse from him.

He said he would have done the same thing in my shoes. SO, he's going to draw up a formal demand and send it certified mail. If neither of the men reply to it or try to get into touch with him, then we're filing a lawsuit. If they don't respond then, I get whatever I want from the deal including the horse.

He has a feeling they will respond to the formal demand, but if they don't...he's going to try to make it sound as though it would be in their best interest to give the horse back...since they will be paying attorney fees...
 
I know! I'm starting to get good feelings and I can almost see him back with me!!!

The lawyer said that we're not only going to get the horse back, but he's going to pay attorney fees, court fees, damages, lost compensation (he would have been to his first show this year)...and then there's the criminal charges that are being filed against him.

The uncle, if he fails to respond and does not give the horse back within 2 weeks of the formal demand, will be facing civil charges as well...

I can almost breathe a sigh of relief!
