Stolen Horse--Man is BACK in jail!

If he was in such bad shape why was he trying to sell him to you for $5000 then? The uncle is stupid, he should cut his losses, give you back the horse and tell the authorities he didnt realize it was stolen, then get his money back from the nephew... he's really digging a deep hole for himself saying he knew it was stolen and bought him anyway... sheesh.

My next meeting with the lawyer is on Monday at 3:30. Other than that...I have no news except that now I'm going to have to sue.

Just ridiculous.

RoPo, I am so sorry you don't have Max back yet. The man who has him sounds like a mean petty and vindictive person who really has no reason to be that way to you. He is just causing you trouble.

I'm sure everything will turn out OK, but MAN, this is rough.
 
I wonder if getting the ASPCA will help? Maybe if someone called in reporting that the horse was "not well" and that it is rumored to be stolen, they would go and investigate. Especially if that "someone" happened to have your number and name. The animal control officers have the authority to arrest and investigate, maybe they can help you.

And I agree, the vet records should be checked out. If he had a large amount of vet work, there would be records. Perhaps calling his vet to report the animal stolen would put a little pressure on him too.

And lastly, my hubby suggested you "sell" the horse to someone else, if that person has a signed bill of sale from you, then they are the legal owners right? They can go demand the horse, and like someone else said, the uncle should take up the monetary losses with his nephew, who clearly swindled him.
 
After the meeting with the lawyer today, we've decided:









I'm getting my horse back.


We deliberated as to the best possible course of action. Seeing as how my cousin is a police officer in a neighboring county, who OFTEN has to work with the Tahlequah Sheriff, we're going to see if I can get my cousin, a sheriff deputy from both Claremore AND Tahlequah as well as my ranger friend. What will this result in?

Going to get my horse forcibly. I am covered by every fraction of the law. If the man pulls a gun, I have 3 people to help keep me safe. If he makes threatening motions, I will have 3 witnesses and will be able to get a court order to have the horse returned to me. Either way, Max is coming back to me. I have to get everything orchestrated, as well as get a trailer in order to get him back (hopefully with a trailer this person will never see again).

Max is going to a place that is WELL hidden and is hardly connected to me at all. He won't know where the horse has gone. AFTER I get the horse back, I'm going to make civil charges against both men, and criminal for one, possibly criminal for the other.

The topper, is that the man who leased my horse claims he could not get into contact with me. Yet he moved 10 days after I went to his freakin' house! He "sold" my horse for $300 to his "uncle" 10 days after I was at his house. How on EARTH could he claim he couldn't get ahold of me?

And that's where the lawyer says that the man who leased him is going to jail. There's simply no support for anything he says.
