Did the judge even go out to look at Max? If not, maybe the uncle did something with Max along time ago.
excellent point. The uncle might have hid Max long ago and now that his back is against the wall, he just made that lie up. Lying, to this family, comes as easily as breathing apparently.

I thought the Judge saw him before she even go to news to get her horsie?
I'm inclined to wonder whether either a) the judge did not actually go out there to look at max after all, or b) she did, but it was unclear to her whether max was really in fact there and this is her way of "giving the uncle enough rope to hang himself" i.e. to get himself undebatably and undisputably into maximal hot water.
Hoping to be wrong, since if Max was sold or moved many months ago it may be real hard (not impossible) to find him,
