Stolen Horse--Man is BACK in jail!

My guess is those are criminal charges. If it was civil, you would be paying the lawyer and it would be you against him. In this case, the state is prosecuting him for breaking the state laws.

its gone past civil... although i think that you could still press civil charges aganist him for the price of the horse.....maybe?

Yes, this is a prosecution, so it's the government vs him. If you are unable to retrieve the horse, then you will have to file a separate civil case that will be you vs him. There is always the possibility too that the criminal court judge will order him to pay restitution. If the guy's attorney (most likely court appointed and paid for with your tax dollars) is worth anything, he will advise him to return the horse so the judge will be more lenient in sentencing.
 
That's the thing. He "claimed" he has been trying to talk to his uncle to return the horse, but the uncle said that he would have to buy it back for $7,000. The uncle is the one that is the big hurdle now...so I'm confused as to which person to file against. I mean, it seems like a straight shot to me that I should go for the guy who leased my horse and did the illegal thing. And be able to retrieve my horse from HIM, but with the uncle being the person that he is...
 
Yeah...whole big bunch of freakin' fun isn't it?!

As soon as I am able to find out information from the DA, I am going straight to the sheriff's office, filing a report against the uncle and then heading to my hometown to file the case as well as get a new license....it seems mine *cough* expired.....

But as for you and the uncle, there shouldn't be any issue, you should just get some help from the police and go get the horse.
 
See, that's how it seems in my little world too, but let's just see if that's the case when I can talk to the DA. To me, it's an arrowshoot straight to the target, I shouldn't have to bounce off a rock to get there!
