If you go get the horse you can get traspassing charges but i would do it anyway and let the judge throw the book~ Your sheriff should be introuble for not doing anything!! he is ellected you know

so you showed the reg pappers and a few photo's?...i'm really surprised that the deputy didn't ask for proof of owner ship on your part, normally pic's just don't cut it...last year we got a horse for my daughter, this horse was dumped at 2 farms, sold once (guy bought her rode her once and beated her to the point where she had welts ) the BO waited 4 months for him to returned (which he didn't) called us and told us to come and get her and give her a good life.......it's been almost a year now and there's been no calls about or horse, if he where to show up tomorrow and ask for the horse back! i'd have to give him the horse back....BUT...the question would be? why haven't you asked or cared about the horse since she's been gone?,

when it came time for my to lease a horse or leased one out i was always checking up on the horse....but like i said i hope you have the bill of sale for your horse...that's the main point

But.. I'd still go get my horse though.. AFTER i talked to the man. I'd go there and be very polite and explain the situation like an adult...and THEN...if he refused to give me back MY horse. I'd call the police myself. He wouldnt have to call them..I would call them. As i said..at the very least they will HAVE to file a report....which would help you in court. IMO. The contract was broken, and so you went to go get YOUR horse back...dont see any laws broken there..IMO..

I doubt you will need a bill of sale, for when you first bought the horse yourself, BUT one would be helpful. I think as long as you have a signed lease, it is apparent that he did not own the horse.

This pisses me off. I hope you get this figured out.

I had a friend who went through something similar, except the horse was stolen outright from her property. She found and stole the horse back. A year later, the people who bought the horse from the theif, took her to court and won. She had to give the horse back.

You better push your sheriff and hard. Tell him you want the animal placed in official possession until the case is settled. That way the other party can't sell him before this goes to court. Sounds like the sheriff needs to be prodded out of his comfy chair.

Papers are proof of ownership provided the horse is obviously the same one. The lease agreement provides extra proof that it's the same horse since it proves this guy leased a horse looking like that from the person who is the recorded owner on the papers. For AQHA at least having registration papers with your name on them means you turned in a bill of sale signed by both parties to AQHA and they officially changed the name from the previous owner. APHA is the same. If nothing else the registry can pull up the original signed contract but having the registration papers should basically be your bill of sale. It's more than enough proof of ownership once someone actually goes through it all.

Personally though I would have microchipped a horse I was leasing. You can chip horses just like dogs and cats. There's less point since odds are your horse isn't going to go wandering off and have no one notice. In a case like this though where you might need to prove ownership it would erase all question and probably move things along quicker. If you can just say go scan the horse, here's the papers saying it's mine. Then it would get sorted out a lot faster instead of someone having to looking over the papers, lease, and photos and get everyone's story to be sure it's the same horse.​

Call up the associated he is reigstered with and have your horse flagged as stolen, if he tries to sell knowing your horse is registered, through a sales barn, they will check any identifying marks with stolen horses declared.
 
I had planned on microchipping him, I just never had it done. I really did mean to though. As soon as I get him back, that's the number one thing that is happening.

I called the sheriff's office here in c-more and he said I have done all I can do. I've talked to my attorney and we agree I won't go get the horse until this is dealt with. I AM debating asking them to take the horse into possession but where on earth would they keep it? The shelter? And risk the horse being adopted?

Just too frustrating to explain. I want to slap everyone (except the c-more sheriff's deputy...at least they are attempting to help me)!
