All lease agreements should always spell out the terms for payment and repo. All boarding agreements should include a collateral agreement stating that the horse will become your property if payment isn't made in a certain manner. I board horses on my place. People have tried to cheat me, but I always win. I make thwm sign an air tight collateral agreement. When somebody comes and asks to board a horse, I always point to Spunky (a beautiful Arab) and say, "See that one. He used to belong to somebody that didn't pay. He's mine now, and I sold the others." I've had a lot of people change their mind about boarding here after I tell them that. That's just fine with me because I don't need deadbeats. Contracts should spell out exactly what happens in worst case scenarios. Even if it's a friend, business is business. There is no point in having a contract if it doesn't protect you.
