1. My dad and I were waiting for the ownership hearing to begin at 1;30. It didn't happen until 4:00PM. The people before us had a divorce hearing thingy going on.
2. I was the first witness and presented the entire story, dates, times, phone records, etc. Told them the term of the lease agreement, EVERYTHING I could think of. The DA gave me a thumbs up as I left the stand.
3. He got on the stand, first stated the horse wasn't the same horse. The judge looked at photos and declared they were the same. Max was in, apparently, AWFUL condition because he wouldn't let me see the same photos. He again claimed Max was on death's door and told me I was lying about the dates that I went to see Max. His reasons? He apparently had already purchased Max in March and had him moved to his OWN property. I asked him how I could have taken photos at the new place if I didn't know his address. He presented vet bills where the vet fixed up his feet or something. The judge said "Well, that's all good, but this is not about restitution. This is about ownership." He could present nothing that showed Max was his.
4. I got BACK on the stand and presented the photos on my phone, laptop and in my hands that showed the date, the judge accepted THOSE as evidence.
5. The judge said she would deliberate, would tell the DA the result and he would get into contact with us. So I still have NO idea what's going to happen. She did court order the two men who showed up (NOT one of them was the one who I leased my horse to) to keep Max in good condition and to not dispose of him under any circumstances.
6. The man's son got on the stand and tried to play the sympathy card saying "My 7 year old is not going to understand why this woman is taking his horse. He worked on this horse when he was sick...why should this woman get the horse back?"
7. The judge pretty much just sat there and let him have his rant. I almost stood up and said "It's not my fault you did not check out who the REAL owner was. Plus...I'm not big on kids...let me tell him."
So, that's pretty much what's up. I'm waiting on word from the DA as to who gets Max and we will work out a time and date for when I can go get him.
8. Forgot to add, both men kept saying they wanted restitution from ME. Um...not going to happen.
ETA: Both men tried to corner me after the hearing, but the DA and my dad wouldn't leave my side.
I can not believe they wouldnt let you see pictures....there must be something someone can do how long till she says?? my goodness sounds like there was nothing else to prove....
