Stolen Horse--Man is BACK in jail!

Fine. Send me the uncle's name. Seriously. I am a member of ancestry.com and can track down darn near anyone. It is pretty creepy but I have access to TONS of public records. He would be easy to find.

Contact the largest newspaper in the area and in yours and see if they have a consumer reporter or a legal reporter. Make a time line or just copy the file you have and mail the whole thing to them including all of the names of lawyers, deputies, clerks, judges the whole thing. Send it or drop it off as many places as you can and don't forget to include pictures of him and hopefully of you with him and your ownership papers and a copy of the lease. I would also let the DA's office know you are doing that it may put a fire under their seat so they get off their office chair and get on the phone. You have tried the legal route and I know we have a section in our paper that just deals with consumer issues and not only do I enjoy reading it, they get the job done.

As far as leasing a horse I had never heard of that until four years ago and a friend leased a horse for her daughter to use. She now owns the horse but even when she was leasing it she found out the owner was letting someone else use it and she put a stop to that because she had the lease on the horse. She was paying to keep the horse at the owners stable becuase they lived in town. She found a different place for the horse after that and she eventually bought her daughter a horse (not sure if it was the same horse as they leased). Leasing a horse is pretty common she told me.

And RoPo, I know it's expensive, but I think you really need to bite the bullet and get a lawyer. If you can find a young, hungry, ambitious person who will move some mountains, it would be just the thing. Maybe those people think you are not really serious, and if they throw enough roadblocks in your way, you will give up. Time to show them otherwise.

Having said that, at this point I am all in favor of tracking down the person who actually has the horse and hiring some muscle to take him back. You have tried to work with the legal system for a long time, and it's just not working for you. I can understand your reluctance to take this route, but how much more can you stand??

If you can locate the horse, you have a lot of offers from BYC'ers to help you get him. I wish I knew someone down in Oklahoma. Hang in there.

I realize that getting another attorney would be the best bet, but I cannot afford one. It's simply not an option. I can only work with what I have, and I do not like to accept charity...it's just how I was raised.

If I can locate Max, you guys will be the first to know, but without knowing the son's name, there's no way for me to track him down...plus there's the issue of what if he owns several stretches of land, that are NOT listed as an address? I cannot take weeks of of work to find him. I am going to be contacting my employer to see if one of their lawyers may be willing to help an associate.

eta: I would get a free consultation with a few lawyers on the phone. If anything, they will make you aware of all of your legal options

Have a very good friend of mine who is now deceased that had (what was edited from my post) as a bumper sticker. And he was known in all our local towns for it and for being the most honest nice person you have ever met. Would bend over backwards and when he died suddenly had the largest wake and funneral I have ever seen for someone who was just a local. I don't think there was a person in our area he didn't help at least once or twice.

Small claims is very effective for monetary problems. Be prepared for the judge to only award you the monetary value of the horse, and the judgement would be against the guy that leased the horse, not the uncle. If the guy that leased the horse is in jail, you may not collect because he has no equity. You're better off with the ownership hearing or finding him and taking him. If you find him and take him, take him to a state that has a brand inspector and keep him there for a while. A brand inspector can cerify that the horse is yours based on your bill of sale and registration papers. Then sell him to your dad for a dollar and take him home.

just found this saga, how terrible. i think if you had taken him right away you could have played the "aw shucks, i didn't know it was wrong" card. but.... now that you have been thru all this i don't think you can plead ignorance. i think you're doing right with all the documentation. about 25 years ago, when i was 9 1/2 months pregnant with my first baby i heard of a starving pony. apparently the owners had moved away, and left it in their fenced in, small back yard with a bucket of water 5 weeks earlier. i went and checked the situation out, then called the humane society. they said they could come and document his plight, leave some paperwork on their door and recheck on her later. then the woman told me, they have less recourse than i do as a private citizen acting on a defenseless animals behalf. (hint, hint). so i did the responsible thing, i called up a horse friend who happened to be a cop. we went and loaded up the pony and took her home. i left a note on their door with my name, address and phone number. i left the date i picked her up, and how much i charge each month for board, along with the anticipated farrier and vet bill amounts. surprise!!! i never heard from them.
i am sending cosmic strength and good wishes for you and sending thoughts of massive, bloody diarrhea to the uncle (and others too many to list)

I know its A LOT of work, but you should be able to go to the court house and find all kinds of public records. If you can find the Uncle's son's name, you can go to the tax office and they HAVE to tell you of any land that is listed in his name, where it is at, etc. I would do a search like this for everyone involved. They could have Max hidden anywhere, but don't give up. You CAN find him. I agree with the others, you should try to get as much publicity on this as possible! If you don't have the time because of work or whatever, I would be more than happy to help, just PM me if you need anything. Mass emails, letters, phone calls, or whatever. Something needs to be done to light a fire under these people so you get your horse back. I just know that if my horse were stolen, I WOULD get her back, no matter what it took.
