Well, if I were the judge, before I made my decision, I would probably have the horse picked up and kept at an undisclosed location (unknown to either party, so that it couldn't be stolen and have one party accuse the other). I would then get expert opinions on the condition and identity of the horse before I returned it to the owner and made a final judgement against the defendant. I don't know how else they could do it without the potential for all sort of additional underhandedness. Good luck, Ropo. Still pulling for you.

I cant believe the judge hasnt been out to see Max yet. I know the judge has a very busy schedule. But darn, the wait seems forever. Too bad you couldnt offer to drive the judge out there on their day off.

Still watching and waiting..
 
Keeping up with this thread has been like riding a rollercoaster. I have high hopes that the judge will find in RoPos favor....and am praying to that end.

Here are my concerns...
Max was leased in the hopes of keeping his training current while RoPo recovered from a broken bone.
Over these past many months there has been no discussion of whether his training has been supported.
I cannot imagine the kind of reinforcement Max has received IF a seven year old has been riding him. Certainly the man with the lease did not ride Max and the grandfather has not either.

RoPo was any consideration given during the nephew's case for damages by the broken lease? to Max's continued training? If you pursue a civil case for damages, then this certainly should be noteworthy.
Also should Max have developed any bad riding habits that may require rehabilitation because of the neglect of training Max suffered, judgement for those funds might need investigating.

I'm hoping that there are no ill effects from Max's time with unscrupulous people and that He comes home to his loving and careing owner.
