Tempe,AZ homeowners association

There aren't any city code restrictions on guns, in Tempe or anywhere else in Arizona. At least right now. In the old days, guns were banned in Tombstone.

As for a 'sterile enclave'....well yeah, you can find plenty of ugly, pre-fab houses and HoA's in Tempe, and the Phoenix area in general. But you can also find great neighborhoods where people garden and raise chickens.
Personally, I like living in a city. I like having access to museums, restaurants, entertainment. I like being able to walk to the grocery store. I like having public transportation (don't laugh, its getting much better here). I just want to live in my city in a way that I'm not disconnected from where my food comes from.
 
In regards to the posting stating the city code of Tempe as far as chickens being kept, this ordinance, 2009.38, Chapter 6, has been repealed.
 
Bet you can have pigeons. Some bantams are the same size as pigeons.
The "logic" of HOAs defies logic sometimes.

I live in a city with no livestock ordinances, and have around 30 bantams plus ducks and a goose. Even had goats once. Move out of Tempe. I kind of liked it, but I would never live in the "Taco Bell" architecture there!!! The little homes toward the edge of town probably don't have HOA crap, so maybe you could move out of the controled neighborhood and into one of those informal ones. Good luck.

Tempe allows up to five hens in ALL single family residential districts. There are no setback or other rules specific to the birds. However you are subject to nuisance ordinances. HOAs have a legally binding contract with their members, and can be more strict in what is disallowed as long as it does not abrogate a RIGHT granted by ordinance, statute or law. For instance, if a restriction allowed prejudicial treatment of a protected right (such as disallowing certain people by race or religion or disability from living there), that would be unenforceable due to federal law. Preventing people from displaying an American or state flag is unenforceable, as it is a right guarantied by the AZ Legislature. Preventing the populace in most residential districts from having roosters or peacocks does not violate any legally granted rights.

This is a very old thread, and the zoning ordinances have changed dramatically since the thread began. But for years, even before they changed, ALL petitions for a variance to allow chickens were granted.
