it does not include DOMESTIC muscovy.. so that's why the birds MUST be marked as domestics (pinioned wing, leg band, clipped toe or tattooed)
I just called them again to double check. (even have their number programmed into my phone)
if you go and catch a WILD muscovy.. then you do need a permit since the bird wouldn't be marked as "domestic"

also does not include Mandarins, DOMESTIC Mallards (also have to be marked as domestic) or Japanese Cournix Quail.. or any breed of DOMESTIC turkey, duck or goose

as the guy from TPW told me.. they are not going to try to regulate domestics because they are covered under the agricultural code

Yeah...I have a couple of grandkids coming down from Wichita this summer who should be old enough to go out and collect eggs with me. Mike's making noises about sending them home with a couple of bantams (if the Nankins hatch out alright). I told him we should probably see how their mom and dad feel about that first.

Pssst, who says you should ask!! You are Grandma!! If the kids want chickens then the kids shall have chickens!!! Lol

I'm a step-grandma...so, there are some considerations I need to take into account....I'm still working to win over the mom and dad. Can't spoil all that hard work by pulling the grandma trump card just yet.

Interesting. Leads one to wonder why "all varieties" on pheasants would be different than "all varieties" on ducks or any of the others.

Ornamental pheasants are not wild any longer...they've beend domesticated and used in aviaries for ages. Strange that they would differentiate "all varieties" on ducks to mean "all wild varieties" and use the same terminology on pheasants meaning wild and domestic. Gotta love the legal system.

When I called I was told one thing, when you called they said another. I don't have their number programmed in my phone, doubt I will ever bother to do so; and, I had to play hopscotch the first time I called to get to the right department. So, who knows? I'm not particularly concerned about it. It's a single piece of paper and $27...took all of ten minutes of my time to fill out the form, put it in an envelope with the check and mail it. I'm covered no matter who's right. That little bit of security is worth the $27 check, about 2¢ in ink and paper, 5¢ envelope and the stamp. In other words, less than $27.50/year.

I am not saying you are wrong. I said my information was different from TPWD (not "Fish and Game" - I don't even have a number for fish and game) and I felt more secure just making the effort. So, I'd imagine it's all good

your saying it hasnt already! im not at all prepared to start hatching out 100's of eggs like some, but scooping up the breeds when they become available i am not opposed to. was just given access to a bunch more chain-link and given the OK to start expanding my operation...so im in a good place right now.

I was told that there are too many species of ducks and geese that would be covered if they had to list them all.. so they used a "catch all" saying "all" just to simplify.. meaning all WILD ducks, geese and turkeys native to Texas.. however since domestic birds are covered by another department and are not "game birds" so they aren't included.. even muscovys and mallards are covered under federal regs for migratory birds. But if they are properly marked they fall into the "domestic" category.

as a note they state this on the website:
"Prohibitions.
No person may sell, offer for sale, or purchase a carcass or part of a carcass of a dead
pen-raised game bird (does not include skin, feathers, feet, etc.) unless:
i the carcass or part of a carcass is stamped or marked with the identification
number; or
the carcass or part of a carcass is delivered to the purchaser and is accompanied
by a document on which the name, street address, and identification number, if
applicable, of the game bird breeder is printed or written
. "

If that were to hold true for "domestic" birds.. then we should have all found a stamp or marking on the turkeys offered for sale at the store at thanksgiving! (as well as the christmas goose).

Old world birds cover partridges plus pheasants.. and since pheasants are NOT considered "domestic" they are included. I have specifically asked about "domestic pheasants" and was told that there are NO species of pheasants which are considered to be domestic birds. .. if you note they state this on the website: "NOTE: Partridge and all species of pheasant, although not native to Texas, are defined by law as game birds. This includes the chukar, Hungarian partridge, and francolin."

by the way.. department of fish and game is the same as Texas Parks and Wildlife.. 512-389-4800 option 4
I found it rather easy to get in touch with the correct department every time I have called.. and every time I have they have given me the same info (called them several times last year to verify info as well as three times this year)

So I just got off the phone with their enforcement department (same phone number and option 4.. they just transferred me)
First the lady who answered the phone said that muscovys were considered a federal issue and that the state of Texas doesn't even cover them.. then when we discussed it a bit more she told me she would research the federal stance on them and let me know what she can find out. as of right now even enforcement has no info on Muscovys because they aren't covering them under their jurisdiction.

She also verified for me that domestic birds are NOT included in the breeder permit because they are just that.. DOMESTIC and NOT game birds.
