As I was reading through this thread I actually teared up! what great people we have on this site. I'm so honored to be part of it.
First let me also say.. thank you for your service! God bless you!

I don't know if anyone suggested anything like this to you, but this is what we did in a similar situation. Our property was part of a farm that had been split up into segments when the owners passed and was sold in tracts. The tract that we live on has the original farmhouse and a few outbuildings. One of the outbuildings is within about one foot of the property line. We have great neighbors, that's one difference, however that neighbor wanted to put in a drive that was going to be too wide for his property... long story short... we simply had the property surveyed and GAVE him 1 foot of land so that he could put in his drive. In return he GAVE us an additional 2 feet across the back where our building was. Is this something that would be possible? Is there an area of your property that ajoins theirs that you can swap out? give them a foot in one area in exchange for a foot where you need it for the building?

oh.. and I agree.. when you get this resolved.. make sure you have a few roosters.. and if you can.. put an outside light out there for them that comes on at about 2am

As soon as you give the OK, we will all be emailing the local news media... just say the word! I'm thinking this would be a great human interest story, especially if other BYCers from around the country get involved/show up to help... great bunch of folks! We're all in this together! You're neighbors don't know who they are messin' with!

.Maybe you can rehab the current building so that you remove 4 inches somehow. If I couldn't have the hens I would want to move. Either way I would do every annoying little thing within legal bounds every day to annoy the neighbor who made a big stink over the 4 inches. Oh yes I would make that my side therapy. Stinky compost,mowing and weedwacking as early as permitted,camp fires...you get the idea.

I hope you get your chickens and a better neighbor. Put a fence up and/or plant some bamboo and stinging nettle.

Maybe they are off on the property line. Have you done a recent boundary survey for that side? Boundary surveys are a little less than a full one. Ofcourse it might backfire and show the line closer.

Thank you for your service. I have a marine vet FIL and is retired now. He has his sheep farm to keep busy. I would fight if i were you. I can believe people are that ignorant. I would see about taking the extra off and keep at it. If you were a bit closer id help in a heartbeat but i know the drive is a bit far for me. Stay with us and keep trying. There has to be a way around without costing to much
 
You know this kind of stuff just makes my blood boil. Here is a guy who is suffering because he was selfless enough to serve his country and they are giving him grief over 4"s? Something surely can be worked out. When I bought my current home in 04, we didn't know there were several rental homes next to it. We have endured music being played so loud that our dishes rattled in our cupboards, we have listened to the lady behind us who's little dog barks from sunrise to sunset, my daughter has been bitten by another neighbor's dog who he let run loose each evening for some exercise, we had a man raising pit bulls and beat them to make them mean and then had a heart attack and died and left 18 of them in a small cabin. We had a convict move in to one of the rental houses and try to set up a battered women's shelter and the list goes on and on and on. We have endured way more noise and problems from our neighbors than my chickens or goats would ever cause. The goats rarely make a peep and yes the chickens do vocalize when laying an egg, but it is no worse than a barking dog. Yet I got cited for having a few mini goats and chickens. I went to court and fought it and won. Now they leave me alone, but it still isn't legal for our zoning. We need to fight this kind of thing. I too will email the TV station, just say the word. I was about ready to take my fight to the media had it not been resolved. Thank you for serving. My SIL was in the Navy and missed most of the first 4 years of my granddaughter's life. I know what a sacrifice it is. I do hope and pray this all works out for you.

Could you put the coop on skids? That is how mine is built so it is not considered a permanent structure. Even though my coop is a 8'x12' building, it has four 6"x6" skids under it and could be moved around the property, so technically it isn't a permanent structure and is not subject to building codes. Granted, it would take a big tractor to move it, it can be moved.
