Ticket Question! Will my license be pulled?

5j's :

If you can't afford ticket let judge know that as well. You never know unless you fight it.

You never know unless you ASK... fighting it would mean lying and saying you didn't do it...

Being a grown up, IMO, means taking responsibility for your actions... not fun sometimes, but you'll get a lot more respect from me (and others in theory) if you act like a grown up... if you want to be treated as one then act like one... be honest, about your infraction, what you've learned, what you can or cannot afford, etc.

If you are sincere, honest, and respectful of yourself, the officer and the court it's a great step.

But there's always the risk that just like you or me the judge might be having a bad day so be prepared for the worst. Find out what the worst is... the whole fine I presume... and if you go to court there's usually add'l court fees too... be prepared to pay, and happy if not.

You don't need to plead guilty ask for a contested hearing (you check that box on the back of the ticket) to explain the circumstances. You can say you were speeding if you wish. Want you want to point out when you go to your court date is the fact that it was your first ticket and that you were in a hurry why if so. The financial issue if any. You can ask for a deferment. I was just given one on my first ticket. It says if you don't get any more infractions for a year this one is dropped off your record. This is what I would do and did do.

Good luck!

Go to court, tell judge it was your first offence, sincerely appologize, tell him/ her that you are aware that you broke the law, but consider this a true lesson learned. ask judge to throw it out. I fought a ticket once, went to court officer read statement that he clocked my speed on radar as he was behind my vehicle. I spoke up and said actually he walked out in the street and pulled me over. He goofed on his statement. Judge threw it out because statement was not acurrate. I got lucky on that one. But I also showed up to court in a suit and tie. That makes adifference too to a judge. If you can't afford ticket let judge know that as well. You never know unless you fight it.

Exactly check not guilty if the option I said is not there. It is your right to mark not guilty and their job the officer and judge to prove you were. So by marking not guilty you are not necessarily saying you are not guilty it is how you want to plea to get a court date and get things lowered, removed, and/or make them prove you were guilty. Don't be scared to go to court it is not that bad. You are not the only one going through this they are not gonna hang you or nothing over it. They see tons of driving infractions every weekday. Just be careful and drive safe though in the future.

My son is in some trouble right now not for driving but being in possession of alcohol at school and you are given a court appointed lawyer in that case. He was told to plead not guilty no matter what to start and it will more then likely be dropped on a technicality. The prosecuting attorney has to prove he committed the crime legally and that he actually did it.

If you need more advice just ask.

I would plead not guilty and go to court. If you still get points on your license, take a defensive driving course. In NJ that will get rid of two of the points. Sometimes if you take the class immediately after court online, the points will not show up on the report sent to the insurance agency and your insurance will not go up nearly as much, if at all. I just had a friend go through this whole thing.

Look up the laws in your state though. It varies from place to place.

Great advice! In college, I got a traffic citation from a city cop. My landlord just happened to be a University cop, and his advice was similar:

1. Plead "no contest" with explanation
2. Dress your best
3. Be respectful, "yes, your Honor"
4. Be patient and have a pleasant look on your face (don't frown, or show any disrespect)
5. Don't make excuses, if the judge is experienced, he/she has heard them all already

Four people went before the judge ahead of me with the same violation. Minimum penalty of those four was $200 in fines, so I was shaking in my shoes. I walked out paying $30 out of my pocket.

Your mileage may vary. Good luck!
