as seller u have the responsibility to package it so it won't get broken for example padding, foam ect and useing an over sized box. as a buyer if u purchase insurance u expect to get ur item as it is described in auction or insurance will pay for it. but if seller didn't package it properly insurance won't cover it. that places the responsibility on the seller. i'd definately fight it through paypal. i would put in claim, u purchased insurance and seller failed to package properly and it was broken and insurance won't cover it due to improper packageing. i'd ask for full amount includeing all shipping charges. if u need help with it pm me.

who bought the insurance,,,buyer or seller?? I am not clear on this.

I am assuming buyer paid for insurance and seller purchased it??

any way you look at it , the seller screwed up . seller is liable.......... I want to be on that jury...
 
Thanks Mar. I'll let you know if I need any help. The seller has been in contact with me about them trying to contact UPS and get it resolved. As for the insurance it was included in the cost of shipping with the ebay auction.

UPS won't deal with me because the shipper purchased the insurance and therefore other than me reporting the damage it's now between the shipper/seller and UPS.

Me, I'm just trying to get my money back for something that did not arrive in the condition I was purchasing it.

Well, Pay Pal says otherwise. (Coming from someone that sold on eBay for 10 years.) Yes, it's their responsibility to get it to you, but it's also their responsibility to get it to you in the condition that you bought it in. I would almost gurantee Pay Pal will side with you. I would file immediately, if you have not already, show the pictures of how it arrived to you, etc., etc. If you paid with your credit card through Pay Pal, you can go through your credit card company, but I think Pay Pal will refund you regardless. Then they will have to get the refund through UPS.

Take it from someone who's been there -- filing a dispute with PayPal is worth the effort. They will send you the documents you need to fill out, you'll fax it back to them with all the photos and a copy of the eBay listing, and eventually you'll be reimbursed.

One thing they will ask for is something in writing stating that the unit can't be repaired or isn't worth repairing. In my case it was a broken LCD screen on a tv that would have cost more to replace than to buy the unit brand new (and it was listed on eBay as being in brand new condition).
 
i a 100% agree with asher and i've been a seller/buyer on ebay and used paypal since 1999. do it now u only have so many days to file for it and yes i agree i see no reason for them to deny it either. u should be able to get back everything includeing shipping but the seller can request u to ship back the dickey for full refund to be recieved. u need to put ur foot down now and stop being so nice (lol ur a sweetheart i know that is hard to do but you have to;))before u r out everything since u only have so much time to do it in. that is alot of money and i'd not be playing around on this one..

i bought a dry heat sterilizer for tattooing once and it came the same way via ups and i paid about $250-300 +ship for it. we had to do the same thing. seller should immediately refund u shouldn't have to wait on that claim that is all on them. we got umteen excuses and the run around she was trying to stall so time for claim would run out. i had to file for paypal and was granted everything includeing shipping. paypal sided with me because it was not useable in any way it wouldn't even turn on and had pieces smashed also inside and out. the seller was responsible for inpropper packageing and also for item not arriveing in condition it was sold in.
