But even attorneys can make mistakes ... and errors in filings at subsequent sales have been known to nullify previous covenants. Certainly not saying there is nothing to worry about but I wouldn't worry until it is actually time to worry.
Thanks alot for the encouragement, really! I'm hoping that his main concern or distaste is the hogs, not the chickens. Might have to get some goats or something. Do you have any for sale?

When you purchase when buying property the title insurance company does a search on all recorded titles/deeds on a property. If they pis something (depending on what it is), they pay out for the property. Essentially it is a guarantee that a property is clear as presented.

In theory, if the deed were properly recorded, the bank should have known and it should have been part of the information made available to you at the time you entered into a contract to purchase.

There are lots of variables in all of that mess too so it isn't always clear.

Why on Earth would anyone care about land becoming a farm? Did he only sell off part of his land and he's still close by? I have turned down property while looking to buy when they have some stupid clause attached to it. Like 50% mineral rights? Yeah, right. When I buy property, it's MY property and you're not getting half of anything nor are you going to tell me what I can or cannot put on it. So if stuff like that is part of their deal, there's no deal. Hopefully there's some legal loop hole for you and you can keep your critters.
 
Just got done talking to him. Said that the hogs on our land would make it harder to sell his land. Said he would overlook the chickens but to keep them on the side of the creek opposite his land and to make sure they didn't go onto his property. After all, it was all official.

He owns the land right next to us and he said that if some city folks come out here to buy his property and see the hogs in their pen or sees the chickens running around the yard they might not be as apt to buy the land. "Will devalue his land" But he was nice about it. Just requested that we sell the hogs.

Sounds like a crock of 'S" to me! I bet he made up the whole thing because he wants to sell his property and thinks he won't get as much!

He gave us the copies of some documents that he had gotten at the courthouse. They were signed by him, a witness, and a notary. Can't argue much with that. We may just move the hogs to one of our friends places until our neighbor sells the land and a hopefully country lovin' animal lovin' buyer moves in.
 
Don't move your hogs yet, call 1800 attorneys and run it by them,, consultation is free and they even have pro-bono attorneys, if the bank owed the land and didn't disclose the information, I don't think you have to worry cause the bank would have run a search on it, if you used a realtor contact them, or contact the bank, if no realtor was involved, and I bet it comes down to the can smell the hogs.
