Being in contact with Don Hoenig, the Maine State Veterinarian, he responded with quoting this Law.

Kellie,

I just looked up the law and it states that it’s unlawful to “sell, display, raffle, give away or offer for sale to the public any live fowl, turtles or rabbits under 8 weeks of age in lots of less than 6”. Folks at Chickenstock will need to follow that restriction.

I will be contacting Dick Brzozowski to talk more about putting together some educational material for you to have available.

Anyone not following this Law may be fined (or what ever happens to bad chicken people.)
Also, it is our civic responsibility to understand and follow the laws of the states that we sell, show or desire to do any of these things in.
I will keep you informed as I recieve information.

Well this is what I think...... You just opened a huge can of worms for the people who do and want to sell at chicken swaps. Hopefully nothing becomes of this and the swaps go on since they are such a fun thing and they help many people out who don't want or cant have 25+ chicks. I understand the law but I also know there are GOOD people/GOOD chicken owners that only want to buy 4 or so chicks, and there should be no reason why they can't do that at a swap. As for the bunnies needing to be over 8 weeks of age I can understand that b/c they are still with mama bunny and still need her, but a chick needing to be that old come on, that's ridiculous !! Swaps should be fun for the family... really a place were people can buy a few chicks to start a little backyard flock. Sucks that they are now going to be "watched" or made out to be bad things with "bad people" b/c there not !!

The laws/people should be more worried about all the battered hens sitting in cages with barley any food no water and other dead hens around them, not about how people at swaps want to buy a few chicks. Gosh no wonder why the world is so screwed up (people are worried about all the wrong things) Or how about we worry about the chickens that live in dark coops and NEVER see the light of day !! That spend 24/7 in the dark with gross living arrangements only to make there "owners" a few buck !!! I can think all day of much better things to be worried about !!

This is BYC and the motto is "a chicken in EVERY backyard" we should be helping people start backyard flocks not discouraging them no matter how small or big.

I do believe that chickens are social birds and shouldn't live alone, but I don't think anyone should be able to say how many someone HAS to have and I support the person who only wants 3-4 !!!! Just because someone cant have 10+ chickens that means they cant have any ??

JMO !!
 
I'm not sure but I believe this infringes on the rights of the private citizen to conduct personal business.

I can understand the law applying to a business but not the private citizen.

I wonder if there is a poultry advocacy association to help in this matter.

That is insane for a law to govern non-commercial sales.

i believe they are not, in that you can sell out of your farm. so if that is how it is , and it ever came down to it, which i doubt, then i have room here, just not sure how many from maine will travel here!! and please , no pig castrations, thank you !! LOL

hey spook, can you check into the group that does the windsor show and see how they allow for sales during that show, i am sure that i sold birds from there last yr and i wasnt told that i could only sell 6 at a time. they arent worried so i dont think we should be either.


and i had the state look at my certificate last yr in oxford ma, and i had young birds, as long as i had my cert. he didnt ask how many i am selling..


i honestly believe it is one of those laws that are out there, that are to protect the single chick from a commercial sale. and i doubt they will show up at a chicken swap, and what is it, a fine, woopteedooo,

i am not worried, and i worry about every freakn little thing, believe me.
 
the other thing that doesn't make sense is some local ordanances limit you to 4 hens, so what do they expect you to do, buy 6 and kill 2? (because afterall,you can't sell 2.)
 
Well, here's my two cents...

My personal policy is to sell chicks when they are eight weeks or older.

That way, they are feathered out and can survive better.

I hope this issue doesn't cause folks to look differently at the Chickenstock events.

There are ways of selling chicks AND staying within the limits of State laws.

I think that Don Hoenig's quote of the law must be incomplete. It has been stated here that this law does not apply to sales made between individuals at one of their homes. Maybe whoever said that was wrong, but I doubt it.

In my opinion, if there is going to be a law regarding this, then someone who already owns chickens should be exempt from the six chick minimum.

some coops are just not be big enough to add 6 everytime you lose a chicken or 2 to (insert prediator here) and would be too cold to only have 4 (or whatever number based on coop size)
but how could you prove you have more chickens at home while at a swap.
