12 dead birds and charges filed *update 1st court date today*

I just spoke to the prosecuters's office. In about a week they will have my stupid neighbor's file together and a court date set. The charges filed against him require that he appear before a judge. They have advised me to submit to them a letter regarding restitution. I will have to show documentation of the value of all my birds, vet bill, etc. I have been working on that since this the attack. I should be able to provide plenty of documentation.
 
That's great to hear. It would be great if you could get some broad media exposure on this. It might make some idiots think twice before...well...acting like idiots.
 
Update - The wheels of justice are slowly turning. The Sheriff's Dept said that once the dog owner goes to court the judge should order the dogs' owner to comply with the dangerous dog statutes and they will have 30 days to prove compliance. The county has an agreement with the Nebraska Humane Society to act as animal control representatives to monitor compliance. However, the Nebraska Humane Society basically told me that they won't do anything regardless of the agreement in place. I guess they are just to busy to care about dangerous dogs. When I told that to the Sgt in charge of the road patrols for the Sheriff's Dept. he said, "Don't worry. If they refuse to monitor compliance, let me know and my deputies will." Have I told you all yet today how much I love our Sheriff's Dept. And I gotta say if you all have animal control as worthless as our local humane society, I can see why so many on here have trouble with them. Thank God for the Douglas County Sheriff's Dept!

Hi Jody - I've been following this thread with great interest. Thank you for keeping us up to date.

It's hard for me to imagine how pet owners can be so irresponsible. We have always kept our pets on our property through fences and training and have never had one get away from us. I'm not saying it could never happen but if it did, we would take full responsibility for any damage done. Owning any type of pet comes should come with an obligation to care for that pet, not only by providing for it's needs, but protecting it from harm - and from doing harm to others.

I'm so sorry about the loss/injury of your flock and pets. I really hope you get restitution AND the legal system provides justice.

My question is why does the sheriffs dept have an agreement with a non profit agency to enforce the laws? The HS is not a law enforcement agency or affiliated with any govt entity (although you would be surprised how many people think the HS is a govt agency supported with tax dollars.)

I will say you are very luck in that your sheriffs dept is so willing to follow the letter of the law.
 
Glad to hear that the ball seems to be rolling with this! It sounds like you do have an excellent sheriff's dept.! Good for you! I can't wait to hear what comes of this in the end. It's nice to know that there are some justice systems left in the U.S. that will handle things the way they should be handled. I really hate it took your birds dying to get these dogs taken care of though. So sorry.

our humane society here is run by our county, same as the sherrif's office. And yes our humane society is supported by county tax dollars. When a humane society worker is sent out on a vicious dog call, they call a sherrif to come with them and if the dog is in fact viciuos the sherrif will shoot it.
