In all honesty, I REALLY think she didnt set out in the beginning for things to be like this. She could have started being vague long ago after I had paid her in full. she doesnt benefit for waiting this long, I assume her situation has made a poor change.

But then again I just hate to think that anyone could really do something so cruel.

I am not familiar with the Freisian registry so I can't really offer much advice. I think you have been given some good advice on here.

You are getting a word out about the breeder through us.

Don't let this make you hate the horse industry because let me assure you that not everyone is like that. There are many many good and reputable breeders out there who would never jepordize their reputations/business/customers like this. That is just terrible that you are being done like this especially with the huge amount of money spent on this filly.

I have never been a fan of buying a foal before it is born because of the uncertainty that comes with it.

I certainly hope you end up on top of all of this and you are able to get the foal you bought and wanted. Don't give up on your dream. Keep fighting for what is right, and what is YOURS.

Have you asked FHANA whether she is the registered owner of the mare, whether there is any impediment they know of to the foal being registered, and called the stallion owner to ask if the mare was bred and the breeding paid for? It is possible that there is something you could turn up there, with due diligence, that would render irrelevant all the rest of the angst about registration procedures because maybe the foal is not registerable *anyhow*.

If this was a case of shipped semen, I can see that the breeder may have split the semen into 2 different mares but only paid for one breeding. Now she's trying to sell the "extra" foal without getting caught. Or she paid for one breeding, got one breeding, but has an extra foal that has the right "look" and is trying to sell it, too, as the registerable foal. But the stallion owner is not gonna be fooled. He KNOWS he only got one stud fee and will pursue that with the breed registry. That's probably where she got herself in the bind. She thought the stud owner wouldn't notice. Well, I'm a stud owner and we notice!

In any case, I am sad to say that Pat is probably right that this foal never was registerable. But you've probably got a 50/50 chance that it is a decent foal.

You are full of information. I didnt realize that the mare owners werent allowed to split the semen. I wonder if that holds true for friesians. Because she said she got 4 mares pregnant off one shipment, she was raving about the quality when I met her.

I didnt even consider this. I wonder what Fhana might have to say about it. Thanks for posting that little tidbit!
 
An AVID chip would be just as binding in court. Get any old avid, home again whatever chip and have the vet draw blood, chip the horse so the horse is at least identifiable. He can get the breed registry's chip "in addition" later on if it is ever relinquished.

Keep the heat on her. Turn up the heat on her. Do not let her off the hook, do not take a back seat on this one. Bluff a little here and there if need be. Not big bluffs, but small bluffs may get her to tip her hand if nothing else. I despise stuff like this.

One time I bought a four month old colt from a woman in Illinois. He originally came from a top breeder of western pleasure horses in Minnesota. His sire had produced over a dozen World Champion WP winners, as well as the highest point earning Paint WP point earner of all time, blah blah blah... Dam was by Sweet Talking Chip, Equistat leading sire of money earners. blah blah blah... Well... I get the colt and the paperwork is- well, there's a hangup. The breeder wants to reserve fifteen breedings a year from my four month old that I paid for free and clear and is already in CA (and very sick with shipping fever) and I said "No DICE!" If Darlene promised you breedings when she got that colt, she needs to buy them from me and give them to you." Turns out the WC producing sire had just died suddenly a few months ago and all you know what hit the fan. Months earlier the breeder had made her marketing video of all the babies in pasture, then traded him to Darlene before the video went out. Then she sent out the marketing video, and turns out 90% of the calls back she got were about this colt. Not my problem. She tried to BS me into relinquishing breedings and I said "Look Lady!!! You send those F@$_!^&+! papers TOOO DAY! Or I will send you his freaking nuts in a ziplock baggie! He will be a gelding next week if I don't get papers FedEx'd in the next day or so!" By golly, those papers were fedex'ed the next day. My evil plan was to geld my paint gelding that was already slated for gelding next week, and send her THOSE nuts and just register my colt when the paperwork showed up, but that's another story that never happened. It was my rotten plan B. Now you guys know how devious I am you will hate me forever. That is okay. My point is, you gotta strongarm people like this. They live in their own world where every deal nets them double and if it doesn't they feel cheated. Hope you figure a way to put the screws to her and make her say Uncle. If I was there I sure would. I'm just saying... you gotta put up your dukes or you will get rolled over and done wrong. If you can't put up your own dukes, get someone else to do it. It is not about being cool under pressure. It is just about stating the facts. You might call an attorney and at the very least find out what exactly her crime is and what the possible penalty in jail time and fines would be, in addition to civil damages. I would absolutely shred her to bits if she was standing between me and my paid for horse. At this point I would offer to drop the issue if you got an immediate and FULL refund, plus any money you have sent for care and upkeep (vet, farrier, etc...) I would absolutely clobber her and she would be seeing stars and wish she never heard of me if it was me. You can do the same, or maybe 40% of the same with the same results. Good luck. Doing nothing and being nice does NOT usually turn out to equal good luck, I'm just saying. Sometimes you have to crack a few eggs to make a nice omelette. Go GET 'EM!!! We got your back, girl. you can do it!

Chicken Fruit, it would not matter if it was the FHANA or ANY other breed registry, they would NOT stand for her "splitting the semen" because owner only PAID for one stud fee not !!4!! .Unless breeder means that she PAID for 4 seperete stud fees and ALL were sent in same cooler.

Otherwise one stud fee is ONE stud fee be it live coner or AI. If you were a stud owner you'd be pretty po'd that your ONE stud fee got 4 mares pregnant.WOuldn't happen on live cover so why should it for AI?
