Hi Everyone. I have not been here for awhile since I had to rehome my last try at raising chickens in a HOA. However, our HOA just received the following changes to the Town of Gilbert regulations and I thought it would be of interest to many of you. It appears that these changes will make it easier to have chickens but it will still be dependent on your HOA. My HOA was very receptivie to trying it but they got one complaint and I decided I did not want to have a battle start up in our small 80 home community so I gave up the request and rehomed out chicks. It looks like if this new regulation passes i might try again! They are asking for HOA's to give input into the proposed changes. Here is the proposed regulation.

Dear Homeowners Association Board Members and HOA Management Companies:
The Town of Gilbert Development Services Department would like to provide you an update on existing and proposed regulations related to animals, including aviaries on single-family residential lots. The Towns Zoning Code presently permits the non-commercial raising of animals in five residential zoning districts: SF-8, SF-10, SF-15, SF-35 and SF-43. These districts are defined by their minimum lot area, i.e. 8,000 square feet for SF-8 and 43,000 square feet for SF-43. Animal Raising, Non-Commercial is defined as the keeping, grazing or feeding of fowl or animals not for profit.
· The current regulations in the Zoning Code read as follows:
Existing Regulations: Section 2.107 Additional Use Regulations
A. Animals. In addition to the regulations set forth in Chapter 6 of the Municipal Code and Section 2.103: Land Use Regulations, the following regulations shall apply:
1. Rodents and Fowl:
a. On each lot up to 20,000 net square feet of area, any combination of up to 25 rodents and fowl are permitted. For each additional 20,000 square feet of lot area, an additional 25 rodents or fowl are permitted.
b. Aviaries shall be located at least 100 feet from any property line.
Proposed Regulations: 2.107 Additional Use Regulations
A. Animals. In addition to the regulations set forth in Chapter 6 of the Municipal Code and Section 2.103: Land Use Regulations, the following regulations shall apply:
1. Rodents and Fowl:
a. On each lot up to 20,000 BETWEEN 8,000 AND 10,000 net square feet of area, any combination of up to 25 10 rodents and fowl are permitted. For each additional 20,000 square feet of lot area, an additional 25 rodents or fowl are permitted.
b. On each lot BETWEEN 10,000 AND 20,000 net square feet of area, any combination of up to 25 rodents and fowl are permitted. For each additional 10,000 square feet of lot area, an additional 12 rodents or fowl are permitted.
c. Aviaries shall be located at least 100 feet from any property line WITHIN THE BUILDING ENVELOPE.
Definitions: Fowl. (See Gilbert Municipal Code Chapter 6, Article III. Livestock and Non-domestic Animals, Section 6-126: Definitions): Fowl means chicken, duck, turkey, pigeon, macaw, parrot, peacock, and other large bird. Rodent. (See Gilbert Municipal Code Chapter 6, Article III. Livestock and Non-domestic Animals, Section 6-126: Definitions) Rodent means any animal that is a member of the order rodentia, including rabbit and hare.
In summary, the proposed changes above modify the number of rodents and fowl permitted based on lot size, require aviaries to be located within the building envelope, and limit the number of roosters permitted per lot.
As representatives of your homeowners association, we would like to provide you an opportunity to comment on the existing and proposed regulations before they are discussed and acted on by the Town Council.
