Arizona Chickens

On Friday June 21, 2013, 12 hens were "rescued" from my backyard against my authority. 5124 E. Avalon Dr Phoenix AZ. I would really like my chickens back. We were on vacation and a neighbor was caring for the hens. Two days later they were gone. My landlord came by and saw we weren't home. She called a rescue to pick them up and won't tell me who she contacted. Has anyone picked up chickens in Arcadia area? Please contact me if you know of any chicken rescues in the area.
 
so it seems I need to go buy some padlocks for my pens today. when you all of a sudden you have mystery deaths of a few animals, then discover in the morning the gate is open to the pen(a few times) it is no longer a mystery of what happened to your animals. some people are just sick and cruel and absolute cowards.
Noel, so sorry to hear this news...how bizarre!!! Let us know if you find anything out etc. I just can't imagine why anyone would do this....

Oh NO! That is terrible! Have you checked the humane society? At least they might be able to tell you who picks up chickens. What did the neighbor have to say about it? That is nasty about the landlord!

So sorry to here that. People are sometimes just to self righteous, with out checking facts. Years ago my office was across from a Quentin padlock for a stables. All horses were kept there until they were cleared and declared healthy. A beautiful racing horse, newly retired was being kept there. The gelding was no longer in the money, the owner decides that good care was a wast. I forgot how long he lived like that until he was sold to his present owner. He was a very sweet horse, there is quite a story how he was rescued form neglect. Anyway, he was about 100# under wieght when he arrived. During his 6 weeks in the quotient padoct he was give great care. He had been there for about 2 weeks when one morning I got to work and he was gone. I had his morning apple. When the owner arrived with fresh hay, small amount of grain, and other foods, he came to our office to see if we know what happened and to use our phone to call the police.

A woman, going and coming from work had seen the skinny horse, called he human society to rescue the neglected horse. After a couple of months the horse was back, still skinny. He had to go to court, prove the horse was not neglected. The he originally rescued the horse, was taking care of it, the horse was under a vets and farriers care.

It was not long before I saw a lady at the padock fence, I walked over, it turned out it was the lady that started it all. She was angry the horse was back. I was XXmore :mad: angry, and told her so, told her what I thought of her and the damage she did.

I think a hen is worth $20.00 - $50.00+ each depending. 12 hens = a min. Of $240.00 to what ever more. They were "rescued" by person unknown with the add of the landlord, that is THEFT. Call the police, report a theft of personal property. I am not sure, but! Arizona still has laws, not yet removed, covering livestock stolen. Check into it, you may be surprised. The laws in this state, around live stock as a ranching/range state.

I would call the police. Use the system.

WoW so sad to hear all of these stories. In the town where I live everyone seems to mind their own business and they seem indifferent to what I have in my back yard. Except the person who stole my pot with wild roses and iris plants. Maybe they figured that I have more than I need. I guess I'm lucky so far, it is a shabby town but like I said fairly safe. I do wish that it was safe everywhere.
 
I do, and I don't. I always chick my facts, I go to the person face to face. If noticed a person gone that had animals, I would watch, if I thought they were in danger, I would talk to the neighbors, think a little. I do not jump at a conclusion with out facts. I will not nor would I allow animals to suffer, for me, each case is different and what I will do is different. So fare I have not found a time I had to call authority's. Ex: I saw an horse bleeding with a nasty wound. I stopped ASAP, and inquired about the paster & described the horse. They know who it was. Called him while I was there, told him about his horse. He did not know his horse was hurt, thanked me because he usually only checked on horses in that pasture every few days.

This is why I like living in the country or a community were neighbors know each other. I've been here sense '87, I do not know my neighbors. I tried years ago, was told flat out that they work and have no time for :smack ? Whatever, being a neighbor? Live and let live, if there is an issue talk to them, and resolve.
 
I talk with some of my neighbors especially if they have animals and usually they respond nicely. No one has bothered me about having chickens even though I think that I am not suppose to have them.
 
I had two broodys share a nest this spring and when the first chick hatched on Friday very early in the morning that is how they were. I was worried since they were both first time mommies. The rest of the chicks hatched on Saturday afternoon and Sunday. The first one ran around for 30 hours before anyone else even hatched. Then the hens ignored everyone till Monday afternoon when we moved them to a brooder area and then they changed from sitting behavior to mommy behavior.
I have sen this with a few broodys that it takes a few days from the first hatch to getting of the nest, they need time for hormones to change and it gives all the chicks time to hatch.

I am not trying to defend the landlords actions, but.....

It may not be 'theft' if the following are true:

1.) The chickens were illegal in that city. (if a tenant is in violation of the law, the landlord has certain additional rights and responsibilities to correct the violation)

2.) The landlord must notify the tenant 24 hours in advance of entering the property...if he did not enter until 2 days later, he could have posted a note on the front door of his intentions to enter the property the day (or 2) before, therefore he was within his legal rights to enter the property on that day.

3.) If the there is an emergency (such as animal safety), the 24 hour rule is null. So if a neighbor contacted the landlord to say the tenants left on vacation and their animals were not being attended to, and the landlord found them to be out of food, water, or in this heat without adequate shade, then again he was within his rights to allow the animals to be rescued.


I have no idea if any of these apply, just wanted to be fair to both sides by mentioning them. Landlords (yes I am one) tend to get a bad rap in many situations when the tenant is at fault, like for example when a tenant spends all their money on partying instead of paying rent, then after eviction they feel justified in tearing up the place and leaving it a pig sty.

So, with this said, IF your chickens were legally there; had plenty of food, water, shelter, and shade; a neighbor was taking good care of them in your absence; and having chickens was not a violation of your lease, then the landlord was in the wrong. I hope the chickens are safe & sound back at home now, I sure would like to hear a happy ending to this tragic story.
