I've never really been involved in the political process, but I just emailed all of my representatives. I'm sure many of you, myself included, are sick of feeling like having chickens is something that has to be kept under the rug for fear of being fined by the city. 6 chickens may not be many, but it's a step in the right direction!
 
My understanding is that there cannot be anything to prohibit the raising of chickens. An HOA can make rules all day about the coop or placement of the coop so long as it doesn't prohibit the ability to have chickens.

In the boat example, there is not a law on the books that says you ARE allowed to park your boat in front of your house, same thing with paint color, etc. Since there is no law explicitly allowing these things, they are subject to restriction and preference through HOA. This is the difference from how it was explained to me.

Once we get closer to the law being enacted, hopefully there will be more that clearly outlines that information though. Fingers crossed!

I just had a meeting with the president of my Home Owners Association.
The answer we are all looking for is:

State Law wins!
All home owners association HAVE to abide (follow) state laws!

Chickens will soon be allowed EVERY WHERE is ALL of Texas!

The HOA's can restrict the number and still not allow only roosters BUT 6 hens will soon be allowed!!!

Section B covers municipalities. An HOA is not a municipality.
You are correct..an HOA is not but any and every part of Texas IS in some type of a municipal wherever...

And a state law is a state law....no one gets to pick and choose which laws they want to follow and which ones they don't.

I have been keeping 3 illegal chickens in my garage lol, little rascals have air conditioner etc..... so no stress there.

Every day after I come home from work, I take them out to the backyard,. One on them
My little polish, alias inspector Gadget.... she hydroplanes! It's so awesome to see how much they truly enjoy been outside.

I tried to get people to follow me with a petition with the HOA but, everyone chicken out!
Now I can keep them outside YES, YES YES, NO MORE DUST, POOP IN THE FLOOR LOL.....

NOT YET....Once the bill passes and becomes a law, you can tell your HOA where to go.

It has been passed by the Senate, it still needs to be passed by the House.
 
Please correct me if I'm wrong but, the city/municipalities can still require chickens to be a certain amount of feet away from your neighbors. I live in Austin and the they require your chicken to be 50' from your neighbors. Most subdivision lots are not 50 feet.

yes, the bill states that "they" can still require a coops to be a certain distance away from neighbors but that "number of feet" can NOT prevent you from having them.
