Rush's proposed bill, H.R. 45, is alternatively known as "Blair Holt's Firearm Licensing and Record of Sale Act of 2009," named after an Illinois teenager killed by a gunshot.

According the bill's text, "On the afternoon of May 10, 2007, Blair Holt, a junior at Julian High School in Chicago, was killed on a public bus riding home from school when he used his body to shield a girl who was in the line of fire after a young man boarded the bus and started shooting."

The bill then argues that interstate firearm trafficking and children dying from gun violence create legitimate cause for the federal government to monitor gun ownership and transfers in new ways.

If passed, the bill would make it illegal to own or possess a "qualifying firearm" – defined as any handgun or any semiautomatic firearm that takes an ammunition clip – without a "Blair Holt" license.

To obtain a "Blair Holt" license, an application must be made that includes a photo, address, all previous aliases, thumb print, completion of a written firearm safety test, release of mental health records to the attorney general and a fee not to exceed $25.

Further, the bill makes it illegal to transfer ownership of a qualifying firearm to anyone who is not a licensed gun dealer or collector. Exceptions to this rule include transfer to family members by gift or bequest and loans, not to exceed 30 days, of a firearm for lawful purposes "between persons who are personally known to each other."

The bill also requires qualifying firearm owners to report all transfers to the attorney general's database. It would also be illegal for a licensed gun owner to fail to record a gun loss or theft within 72 hours or fail to report a change of address within 60 days.

And if a minor obtains a weapon and injures someone with it, the owner of the gun – if deemed to have failed to meet certain safety requirements – faces a multiple-year jail sentence.

H.R. 45 is a resurfacing of 2007's H.R. 2666, which contained much of the same language and was co-sponsored by 15 other representatives and Barack Obama's current chief of staff, Rahm Emmanuel. H.R. 2666 was assigned to the House Judiciary committee, where no action was taken.

H.R. 45 currently has no co-sponsors and is likewise assigned to the House Judiciary committee.​
 
Criminals for the most part get their guns from homes that have been burglarized. Guns are taken from honest people that want to protect their homes but don't secure their weapons very well. Of course it's hard to protect your home from a night time visitor with your gun locked in a safe.

What is all the hysteria about Obama gonna take your guns about? He has never said anything about that. As previously stated earlier in this post, that would be impossible. I think he said something about outlawing automatic weapons. Why does anyone need an automatic weapon? Even the Army fires in 3 round burst's. Keeping an M16 on target when it's set on rock and roll is just about impossible and waste a lot of ammo. The only thing an automatic is good for is taking out a lot of people at once. It would be good for defending your home against zombies.

The ammo thing does sound kind of stupid. It would be way too cost prohibitive for buyers and sellers and would waste a lot of taxpayer dollars. Don't worry nobodys taking your guns. The only thing all this paranoia is doing is lining the pockets of the gun manufacturers. I imagine prices have gone way up. I heard ammo has really gone up.
 
While this subject belongs on a political forum, it is important to us all. Whether you own firearms or not the 2nd amendment protects us all. Once that right is removed all others will topple. When a leader comes to power who is elevated to a god like status is the first sign of trouble.

Obama has promised that he will not attempt to repeal the 2nd amendment. This is almost impossible to repeal an amendment, the intent of anti gun movement has never intended this. Their intent has always been the rendering useless of the amendment with "reasonable restrictions". Each small reasonable restriction puts them one step closer to accomplishing the removal of ALL firearms, as Obama has promised to the UN.

Yeah that could happen and that would suck.
 
Having been in Law Enforcement for 23 years and prior military training I can tell you that this is an important right for every American, whether you choose to own firearms or not.

Gun ownership by the citizens is one of the things that make this country very unique and very strong. To have goverment take away firearms from the majority of us, who ARE law abiding citizens will forever change this country and for the worse IMO.

Criminals will always have guns. Taking them away from 'the people' will create more crime and more violence. So-called disarmed societies are facing plenty of murders. Still, if someone is bent on killing they are going to do it, guns or no guns. Many countries that disarmed their citizens now prosecute the very same law abiding people for defending themselves, their homes and property when a criminal robs, attacks or violates them. You must ask yourself is that what you want to happen here?

You wonder why does that happen? It happens because those very governments cannot control the criminals so they go after YOU. I truly feel for everyone from another country who does not have the right to bear arms. Governments with sheep societies (disarmed citizenry) typically do not have good records for protecting their own citizens.

Personally I wish everyone here did own firearms and was proficient in their use. Fortunately I live in a state that has no laws restricting concealed carry. I have a choice just like every other Vermonter (there are 650,000 people in this state). This state certainly doesn't make the news very often for gun violence. Surprised?

I pay pretty close attention to Obama and I don't remember him promising the UN to disarm the US. I fully understand your concerns but it's nothing but paranoia. I would much rather invest in Smith & Wesson than your swamp land.

This country has a lot of checks and balances. Even if Obama wanted to take your guns he wouldn't be able to.

Meanwhile I'm going to withdraw from this because I don't want to be the reason for them to shut this one down.
 
Burch Run farm, ,, Amen!!! In our state (missouri) we just got our concealed carry ability a couple years ago, ya should have heard the people cryin about how it was going to be so much bloodshed. Well, there still waiting. And just last year Missouri passed the law that if someone steps foot on your property in a violent manner you can toast them if you feel threatened. That calmed down a few rowdies around here.
I will give you an example,
Last fall I had a guy who lives down the road who is not quite all upstairs when hes not on his meds. Well I heard him yellin and cussin down the road and didnt think nothin of it and went inside. Shortly there after he came flyin down the road on his bicycle and deliberatly hit my femaly English Mastiff (who is 9 years old, near sited and moves about as quick as a snail) he went flying, my dog limped into my yard which he jumped up, ran to her pinned her down and started beating the crap out of her. My wife and kids and some neighbor kids saw it all happen, I hear my wife freaking out so I go outside, see what hes doin, walk over and litteraly beat the living crap out of him. I then called the sherriff, who informed him that I had every right to defend my property and he was lucky I didnt have a gun with me as I could have blown his butt away if I felt necessary and they wouldnt have done anything about it. They hauled him away to the hospital, (because I realy knocked the crap outta him) and when he got out 2 days later, know one hears a peep outta him.
And he now stays on his meds.

California already has the imprint ammo law in effect along with some very "ruskie" type gun laws that only allows "certian" guns, not types, guns to be purchased there. Also, an FFL (Federal Firearms License) who sends a firearm to California needs to submit and purchase a special lincense to "do business" in California, even the ones that are not registered in CA.

Illinois requires one to have what is called a "FOID CARD" Firearms Owner I D.
This is not hard to obtain, however one CAN NOT carry a concealed weapon EVEN if they have a Permit from another state such as Florida were CCW's are called by the natives "an effort to stop the murdering" in that state. One can also get a CCW in the state of Florida even if they do not live there, Suprised ? Obtaining a CCW is a rigorous, timely and expensive avenue. If you do not wish the FBI to have your fingerprints and picture on file then you need not worry about obtaining a permit.

I believe that a LAW abiding citizen should have the right to bear arms and I further agree that one should have the right to Conceal Carry. Having a CCW does not make you a more powerful person, it actually forces you to be kind and thoughtful and very interested in your surroundings. Pulling a Concealed weapon has DIRE consequences and one really needs to use ones head.

Most people do not know that if a CCW carrying individual is involved in a shooting the weapon is taken away and a full investigation is done. Some people end up in court with expensive lawyer bills for their defense. This is NOT a casual conscious decision even to carry in public.

A criminal does not have a license to buy or carry a weapon. They are impetuous, unpredictable and most do not care about their follow man.
