Can't sell Quail,Pheasant, Turkeys and now ducks and geese in Florida?

Fascinating post. I am looking into Colorado. Thank you AGAIN JJ (mr. awesome IMO) and Quaillady (dittto only Ms.).

OOPS one more question to JJMR794, I noticed your post said your Federally liscensed, what does that allow you to do and what are the requirements for that certification probably to include their share of the money also. Thanks

I have a dozen buttons and a half dozen japanese (ass't) I wanted to be able to sell some and also exhibit them. I do have a seller/exhibit permit because I also used to broker small primates and have kept my permit active just in case.
The FWC warden said we COULD NOT exhibit, show or sell anything other than barnyard chickens, Pekins and muscovies, without the game farm permit. This then wouldn't cover the sales. That's another permit. This is very frustrating to me, because I am under the 50, But i want to be able to sell the pairs and chicks as they hatch..

I contacted Lakeland. They referred me to Tallahassee. 850-488-3641 I was put in touch with Donna in permitting. She explained to me that in order to sell eggs, chicks or birds (ALL species and subspecies of quail) you DO have to have a Game Farm Permit. She said she was unaware of any rules pertaining to barnyard waterfowl or turkeys, BUt she said she is usually the last one to know if there's been a rule change. She said you CAN have up to 50 quail for you're own personal use, but as soon as they're used in a commercial fashion You have to have the permit AND so does the person you are selling them to.
I will be applying for my permit ASAP. BUt, I am still interested in what the Warden will say at the local club meeting regarding Barnyard waterfowl ( Indian Runner, call, appleyard, etc ducks, and Embden, Chinese,Toulouse, African, Sebastapoles ETC geese) regarding the restrictions on them...
 
That helps but brings up another question for me, what does" In a commercial fashion" mean. If the permit is for more than 50 and to buy and sell what else is there? Also if I sell eggs/birds to someone they have to also have a permit or is that only if you sell them more than 50? This make my head hurt............

Dont make your head hurt. Here is what I have been told by FWC and looked up the statuates both. If you SELL ANYTHING and have over 50 gamebirds you have to LEGALLY have the 50 dollar game permit.SELLING ONLY!! Thats whats meant by "commercial fashion". If anybody BUYS or SHOWS birds you do not have to have any permit unless LIke JJ said on the mallards or with migratory waterfowl. If you SELL them (migratory waterfowl) you must possess a federal permit (75 dollars)and when you SELL said birds YOU supply the BUYER with whats called a (form 3-186) notice of transfer sale of migratory waterfowl. so if you want to SHOW or OWN migratory waterfowl you must be able to produce this form. Note the key words in this order,(1) SELLING 50 dollar game permit and 75 dollar federal permit for being able to sell migratory waterfowl(2)BUYING No permits needed EXCEPT on buying migratory waterfowl the seller MUST provide the 3-186 form. (3) SHOWING and posessing only when you have migratory birds. Long story short your game warden is wrong,wrong wrong. These are the people that are supposed to know the law. You should have and could have called her on it right then and there. Me and my fellow CAPTAINS have done it several times on FISHING regulations here and proved them wrong more than once because we ARE FED UP of all the stupid laws, rules and regulations. Its ridiculous and now most of the FWC even agree with us ! Off my soapbox now...for now. Sorry sounds like you gotta Turd for yalls game warden. Most are nice and know the laws in all fairness, except when you correct them and they turn out wrong

You know stuff is screwed up when you try to do whats right but can't because nobody knows what the hell the law is thats supposed to know what the law is without having to consult a lawyer first on what said law is. And youve only talked two people(see what I mean on somebody knowing these laws) UhOh I better stop before my head hurts
