You may need to NOT give your payment to the landlord and instead be giving it to the bank. You may be better off trying to make them evict you as you save up your money and prepare to move. I just don't know. I would call his help line and get some expert advice.

It's just a really cruddy spot to be in. We've been here 2 years and love it. We're just waiting for my daughter whose a sophmore to graduate (2 years) then we were going to get out of the city somewhere be it here in Colorado(lived here all my life) or try some place new. So we haven't told my daughter yet what's going on. I'm so angry at this guy. I think I come to the realization that we have no choice but to move and I have all my chickens/ducks that I'll need to find homes for. Unless we really luck out and find another place close by that I can keep everyone but I'm not holding my breath.
We'd get out now but DD doesn't want to switch schools and I don't blame her.

Anyone going to Territory Days this weekend? We might go Saturday since we are going to be slammed on Sunday. I think it runs Saturday thru Monday. Old Colorado City area of Colorado Springs
 
Are you still paying the rent? I am debating not paying my last month and using it for deposit as I doubt I will get my deposit back from this lady
 
Well as of right now we're caught up but NO, we're not planning on paying him anymore until we see paper work showing that the house has been cured. I wouldn't pay her anymore. It's just going into her pocket and you've already moved so you're throwing away money that you don't have to.

My Last landlord foreclosed on me in March of '08. We were lucky that she gave us a heads up that she was letting it go to forecloseure so that we could start looking for a new place. I sought legal advice and if you don't pay rent they can evict you and have you arrested. Totally sucks cause you know they are just pocketing the money, but because your agreement was with the landlord and not with the mortgage company, you are legally bound to pay rent. They have the right to do whatever they want with the money you give them. Again - completely bites! We did work out a deal that I would not pay the last month and not get my deposit back. I too tried contacting the mortgage company and got the same thing - can't give you any info.

I did find out that if you stick it out until the very end - cause you know you are probably not going to get your deposit back if they are in that much trouble... Any way if you wait until the mortgage company takes over you can usually get them to pay you to move out peacefully and to leave the house intact i.e. no damage and all the appliances still there. I forget what it's called - something about "cash for keys". But in essence they spend more money paying to evict you, replace appliances or fix problems casued by disgruntled tenants that if you agree to vacate the premises within 14-30 days (or whatever you agree on) they will give you a decent sum of cash to get you into another place. I chose not to do that, afraid that if I waited I wouldn't be able to find anywhere suitable to live.

My current landlord told me she has a large debt coming due and may let the bank take possesion of the property I'm on now. I thought "oh great here we go again". I'm crossing my fingers that there will be some chance in @$%! that we can qualify to purchase the property ourselves if and when she does need to get rid of the property.

Thanks Karen. It's $1000 bucks that the mrtg co will give you if you leave the place in clean condition. I guess it's true they can do whatever they want with the money, but my thought is, he's taken $16,000 since November which puts us caught up on our side of the deal. We didn't find out about the foreclosure until about a month ago when a realtor came to the door so we talked to him. Our landlord was fit to be tied when my DH told him we knew about it. All he tells us is "Everythings going to be okay, I'm waiting for some call backs on money" We just don't know what to believe and don't want to be out anymore money. We're struggling as it is.
